Heard Mr. R.A. Chary, learned counsel for the petitioner, and

Mr. R. Venkatesh, learned Standing Counsel for GHMC, appearing

for respondent Nos.2 and 3, and perused the material available on

record.

2. In this writ petition, the petitioner is aggrieved by the action of

respondent No.3 - Deputy Commissioner, Circle No.8, GHMC,

Hyderabad, in trying to demolish his property bearing H.No.18-1-

111/1/A/1 situated at Sikh Chawni, Kandikal Gate, near Uppaguda

Railway Station, Uppaguda, Chandrayanagutta, Hyderabad.

3. It is stated that the Institution by name ‘Sikh Gurudwara’ at

Nallavag Sikh Chawni, near Uppuguda Railway Station, Uppuguda,

Chandrayanagutta, Hyderabad, has been registered in the book of

Endowments vide Muntakapu No.1223 of 1350 Fasli in File No.817/2

of 1350 Fasli. The Institution is having the land admeasuring Ac.0-08

guntas attached to it. In the year 1970, permission was accorded to

the Managing Committee of the Institution to divide their entire land

into plots and allot the same to the members of the Sikh community.

One such plot admeasuring 200 square yards was allotted to the

petitioner on 19.07.1998. The petitioner constructed a small house in

an extent of 75 square yards and it was assigned Municipal No.18-1-

111/1/A/1. The petitioner has also been paying the property tax.

4. It is stated that the subject building of the petitioner is in

dilapidated condition and the petitioner is making repairs to his

building. While so, pursuant to the orders passed in W.P.No.5575 of

2023 filed by one Mr. Sardar Eshwar Singh, action has been initiated

by respondent No.3. Show-cause notice dated 04.09.2025 was

issued to the petitioner directing him to submit explanation as to why

unauthorized construction should not be removed. Detailed

explanation dated 16.09.2025 was submitted by the petitioner stating

that there is no new construction undertaken by him and he has been

making repairs to his old building. Further, the petitioner is not a party

to the said writ petition. It is submitted that without considering the

explanation of the petitioner to the show-cause notice dated

04.09.2025, there is interference by respondent No.3.

5. Learned Standing Counsel for respondent Nos.2 and 3

submitted that the petitioner is proceeding with unauthorized

construction without any sanctioned plan, and that enquiry is pending

pursuant to the show-cause notice.

6. In the above circumstances, the writ petition is disposed of

directing respondent No.3 to conduct enquiry in furtherance of the

show-cause notice dated 04.09.2025, by affording an opportunity of

hearing to the petitioner, the complainant - Mr. Sardar Eshwar Singh,

who is the petitioner in W.P.No.5575 of 2023, and other interested

persons, and pass orders, in accordance with law, within a period of

four (04) weeks from the date of receipt of a copy of this order.

Pending such exercise, status quo, obtaining as on today, shall be

maintained in respect of the subject property. The petitioner is also

directed not to make any construction/alteration/improvement to the

subject property. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any pending in

this writ petition, shall stand closed.
