The court directed administrative authorities to consider and decide upon an employee's representations regarding promotion and seniority rectification within a stipulated timeframe in accordance with the law.

O R D E R :

With the consent of the parties, this Writ Petition is taken up for disposal at the admission stage itself.

2. This Writ Petition is filed under Article 226 of the Constitution of India, seeking the following relief:

“…to issue a Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus declaring the action of the respondents 2 & 3 not considering the representations 23.08.2025 & 27.09.2025 submitted by the petitioner for promotion to the post of Gazetted Head Master (Local Body), Grade-II in Multi Zone-II in any vacant post on par with his juniors by rectifying the seniority list and consequently direct the respondents to give the promotion to the petitioner for the post of Gazetted Head Master (Local Body), Grade-II in Multi Zone-II as per his seniority on par with his juniors by rectifying the seniority list with all consequential benefits, in the interest of justice and pass…”

3. Heard Sri K.Uday Kumar, learned counsel for the petitioner and learned Government Pleader for Services-I for the respondents.

Learned counsel for the petitioner submits that the petitioner is working as School Assistant (Maths) and though he is eligible for promotion to the post of Gazetted Head Master (Local Body), Grade-II, respondent No.3 had promoted the petitioner’s juniors by ignoring his case. As such, the petitioner submitted representations to respondent Nos.2 and 3 on 27.09.2025 and 23.08.2025, respectively, ventilating his grievance. However, no action has been taken so far. Therefore, learned counsel prays this Court to direct respondent Nos.2 and 3 to consider the representations dated 27.09.2025 and 23.08.2025 submitted by the petitioner and pass appropriate orders, within a time-frame to be stipulated by this Court.

5. Learned Government Pleader appearing for the respondents fairly submits that respondent Nos.2 and 3 will consider the petitioner’s representations dated 27.09.2025 and 23.08.2025 and pass appropriate orders, in accordance with law.

Having regard to the submissions made by learned counsel for the respective parties and without going into the merits of the case, this Writ Petition is disposed of, directing respondent Nos.2 and 3 to pass appropriate orders on the representations dated 27.09.2025 and 23.08.2025, respectively, submitted by the petitioner, strictly in accordance with law, as expeditiously as possible, preferably within a period of six (6) weeks from the date of receipt of a copy of this order and communicate a copy of the same to the petitioner.

Miscellaneous petitions pending, if any, shall stand closed.

There shall be no order as to costs.
