ORDER

In this writ petition, the petitioner is challenging proceedings of respondent No.2 dt.17.11.2025 under which the petitioner has been black listed in participating in any paddy procurement of CMR paddy for a period of one year i.e., for two seasons, as illegal and arbitrary.

It is submitted that show cause notice was issued only to explain the shortfall in supply of CMR rice and the petitioner has also submitted his explanation and without issuing any further show cause notice for black listing, the respondents have passed the impugned order. It is submitted that thereafter, the Government has extended the time for supply of CMR rice till 28.02.2026 for KMS 2024-2025 vide Circular dt.24.11.2025.

3. The petitioner claims to have made a representation dt.06.12.2025 to re-consider his case for supply of CMR rice in view of the Circular dt.24.11.2025.

4. Learned Government Pleader for Civil Supplies and the learned Standing counsel for Civil Supplies Corporation are also heard.

5. Having regard to the fact that no show cause was issued prior to passing of the impugned order, black listing the petitioner’s rice mill, the order of black listing is liable to be set aside. Further, black listing appears to be only on the ground that petitioner has not supplied CMR rice within the period allowed by the authorities. Now, the authorities themselves have extended the period for supply of CMR rice for KMS 2024- 25 upto 28.02.2026. Therefore, the impugned order dt.17.11.2025 is set aside and the respondent No.2 is directed consider the representation of the petitioner dt.06.12.2025 in terms of Circular dt.24.11.2025 and also G.O.Ms.No.17 dt.04.10.2025.

6. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
