ORDER

This Writ Petition is filed seeking to issue a writ of Mandamus declaring the inaction of respondent Nos.2 to 5 in removing the encroachments of public roads and road margins situated on eastern and southern sides of the property in TS.No.4/2 of Yellareddyguda, Hyderabad, inspite of repeated representations given to respondent Nos.2 to 5, as arbitrary and illegal and for consequential relief.

2. Heard Sri Hari Sreedhar, learned counsel for petitioner, and Sri M.Arun Kumar, learned Standing Counsel for respondent Nos.2 to 5.

Learned counsel for petitioner submitted that the petitioner is resident of Nagarjunanagar Colony, Yellareddyguda, Hyderabad and is member and Ex-President of Nagarjunanagar Welfare Association; that there is open land in TS.No.4/2, Yellareddyguda, Ameerpet, Hyderabad, belonging to LIC Employees’ Mutually Aided Court-Operative Housing Society Limited and on northern, southern and eastern sides of the said property, there are roads which connect Nagarjunanagar, Srinagar Colony to Ameerpet main road; that the residents of Nagarjunanagar and Srinagar colonies as well as commuters coming from Jubilee Hills also use the said roads to avoid traffic from Khairatabad upto Ameerpet junction; while so, some third parties have encroached the said road, constructed temporary shops and leasing them to vegetable vendors, thereby closing half of the road, which is causing inconvenience not only to members of the said Colonies but also the commuters who use that route.

Learned counsel further submitted that some encroachers are doing retail business of manure, sand, earth, demolished building waste and other building material by dumping the same on the aforesaid road in large quantities, thereby encroaching the road. He further submitted that aggrieved by the same, the petitioner, as President of Nagarjunanagar Welfare Association, had submitted representations on 27.08.2010, 03.02.2011 and 30.04.2011 and the Secretary of the said Association has also submitted representation on 11.06.2014, however, the respondents are not taking any action and hence, aggrieved by the same, the present Writ Petition is filed. 4. Learned Standing Counsel for respondent Nos.2 to 5 submitted that respondent-Corporation has taken up the issue and removed all the encroachments as well as the material dumped on the road and at present, there are no encroachments or dumped material on the road, and in fact, planting has also been done on the road margins by the respondent-Corporation to avoid encroachments and dumping of material in future.

5. Learned counsel for the petitioner did not dispute the same, however, expressed apprehension that third parties may again encroach and dump material on the road margins and therefore, prayed to pass appropriate orders.

Considering the above submissions of learned counsel appearing for both the parties and having regard to the facts and circumstances of the case, this Writ Petition is disposed of with a direction to the respondent-Corporation to ensure that no encroachments or dumping of material takes place in future on the aforesaid road margin.

7. As a sequel, Miscellaneous Petitions pending, if any, shall stand closed. No costs.
