ORDER:

This Writ Petition is filed with the following relief:

“…to issue a Writ of Mandamus or any other appropriate Writ, order or direction, declaring the action of the 5th Respondent in forcing the petitioners to close their shop with the name and style of Maheswari Xerox and General Merchant and Maheswari Stationers, situated at D. No. 7-6-39/8, Haricharan Complex, Station Road, Nizamabad from 9.00 am to 12.00 noon every working day during the period of Intermediate and SSC examinations both regular / instant improvement, supplementary etc., inspite of the orders dated 25/03/2014 in W.P. No. 8516/2014 of the Honble High Court, as arbitrary, illegal and in violation of Article 14 and 301 of the Constitution of India and not mandated by any law and consequently to direct the Respondents not to force and interfere with the Petitioners timings of opening and closing the Maheswari Xerox and General Merchant and Maheswari Stationers during working days in the interest of justice and pass....”

2. None appeared for the petitioner.

3. Heard Mr. D.Pradeed, learned Assistant Government Pleader for Home, appearing for respondent Nos. 1 to 5.

Learned Assistant Government Pleader for Home submits that neither the police nor respondent No. 5 have ever forced the petitioners to close their shop or interfered with their business activities without any lawful basis. However, he fairly submits that this Court, by an interim order dated 13.03.2019, directed that the petitioners shall not be prevented from operating their shop unless it comes to the notice of the police that the petitioners are indulging in or abetting malpractices during the ongoing public examinations. In view of the said circumstances, he prays for passing appropriate orders.

5. I have perused the material available on record.

6. The grievance of the petitioners is that respondent No. 5 has been interfering with their business operations during the conduct of Intermediate and S.S.C. examinations, both regular and supplementary. Having regard to this contention, the interim direction earlier issued by this Court, and the limitations of the police in such matters, respondent No. 5 is directed to refrain from interfering with the petitioners’

business, except in strict accordance with law and by following due process.

7. With the above direction, this Writ Petition is disposed of.

There shall be no order as to costs.

Miscellaneous Petitions, pending if any, shall stand closed.
