IN THE HIGH COURT FOR THE STATE OF TELANGANA AT HYDERABAD HON’BLE SRI JUSTICE NAGESH BHEEMAPAKA WRIT PETITION No. 27743 OF 2025
18.12.2025 Between:
Sukka Dayanand .. Petitioner And State of Telangana Rep. by its Principal Secretary, Department of Energy & four others ..Respondents
O R D E R:
This Writ Petition seeks a direction to Respondents not to carry on the proposed construction of 33/11 KV Sub- Station in Survey No. 103 at Medipally in Medchal Malkajgiri District without considering the objections from the local people and petitioner's representation dated 28.10.2025 and in the interest of ecological sustainability along with the public safety.
2. The main contention of petitioner is that Respondent-TGSPDCL was making construction of 33/11 KV Sub-Station in the above Survey Number. It is stated that a piece of land was allotted to TGSPDCL by the Government for construction of Sub-Station without following the procedure for allotment of land and the Revenue Department has no clarity on the area allotted for the said purpose. It is contended that the land which is allotted has huge rocks and trees and removing the same would disturb the ecological balance and would adversely affect the area. Further, there is a Government ST Hostel for Girls adjoining the area allotted for Sub-Station and construction of sub-station will affect the lives of more than 300 girls who are accommodated in the said hostel apart from the fact that heavy power voltages and other issues would become dangerous to the lives of the local people. It is contended that local people of the area submitted representation dated 28.10.2024 but no action is taken, therefore petitioner seeks a direction as stated above.
3. At the stage of admission, this Court by order dated
15.09.2025, stayed construction of sub-station.
4. The 2nd Respondent-TGSPDCL filed Counter Affidavit contending that the Superintending Engineer, Operation, Habsiguda Circle vide letter dated 05.07.2024, requested the government for allotment of vacant government land to an extent of Ac.0.08 guntas in Survey No. 103 of Medipally for construction of new 33/11 KV sub-station to meet the growing demand of power supply in view of drastic urbanization / emergence of new colonies in and around Medipally; the 4th respondent submitted the report dated 22.08.2024 stating that the field staff and the TGSPDCL authorities have visited the government land to an extent of Ac.2.00 in Survey No. 103 which was already allotted to Rajaka Sangam by the 3rd respondent vide proceedings dated 07.01.2019 and handed over physical possession to the District BC Welfare Department. It is stated, the Government vide Memo dated 6.11.2013 accorded permission to the District Collector for handing over advance possession of Government lands in case of transfer of Government land from one Government Department to another Government Department (under BSO 23) and in the said process, also issued GO Ms. No. 571 and G.O.Ms. No. 61, intimating the procedure to be followed. It is stated that the 3rd Respondent District Collector, based on the Application of the TGSPDCL, directed the 4th Respondent to hand over advance possession of land to an extent of Ac. 0.08 guntas in Survey No. 103 to TGSPDCL duly demarcating on the ground and clearly showing the boundaries, for the purpose of construction of sub-station. The 4th Respondent conducted panchanama and by showing the boundaries on the ground, handed over the land in favour of TGSPDCL. Thereafter, financial sanction was released by the Corporate Office of the 2nd Respondent on 03.12.2024; tenders were called for and work was awarded to M/s Anil Electrical and Sanitary Goods Stores who started construction work of sub-station. It is stated that said work is strictly being carried out in the land allotted to TGSPDCL and land which was filled with rocks was made fit for construction.
