ORDER
This Writ Petition is filed seeking the following relief:-
“…to issue writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the Respondents more particularly Respondent No.3 in not disposing the Petitioners Appeal vide Application No.VKB0000466 of 2025 dated 17.06.2025 filed under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 is illegal, arbitrary and violative of Article 14 and 300A of the Constitution of India and consequently direct the 3rd and 4th Respondents to take immediate action against the Respondent No.6 from evicting the Petitioners house bearing H.No.170 situated at Udimeswaram Village, Kondangal Mandal, Vikarabad District …”
2. Heard Mr. G.Krishna Rao, learned counsel for the petitioner and Mr. Yadagiri, learned Assistant Government Pleader for Energy, Women, Children, Disabled & Senior Citizens Departments appearing for respondent Nos.1. Perused the record.
3. With the consent of both the parties, this writ petition is being disposed of at the stage of admission.
4. Learned counsel for the petitioner would submit that the petitioner is a senior citizen and has filed a complaint seeking protection of life and property before respondent No.3 under Rule 4(1) of the Telangana Maintenance & Welfare of Parents and Senior Citizens Rules, 2011(‘Senior Citizens Act’ for brevity) and application No.VKB0000466 of 2025 has been assigned to the petitioner; that the complaint is against the respondent No.6 who is none other than petitioner’s son. Pursuant to the said application neither notice has been issued nor the grievance has been redressed as per the time limit prescribed under the Senior Citizens Act and hence, he would seek to pass appropriate orders.

Learned Assistant Government Pleader for Energy, Women, Children, Disabled & Senior Citizens Departments would submit that the case of the petitioner is under consideration before respondent No.3 and the same would be considered by issuing notices to all the concerned and after granting sufficient opportunity of hearing, and that it is admitted fact that O.S.No.128 of 2022 i.e., partition suit is pending before the Civil Court and hence, this matter requires detailed examination and after conducting detailed examination, appropriate orders will be passed by respondent No.3. Hence, would seek to pass appropriate orders.

Having heard the learned counsel for the petitioner and learned Assistant Government Pleader for Energy, Women, Children, Disabled & Senior Citizens Departments, since the prayer sought by the petitioner is innocuous, this Court without going into the merits and demerits of the case, deems it appropriate to direct respondent No.3 to examine the case of the petitioner by issuing notices to the concerned parties and affording sufficient opportunity of hearing and pass appropriate orders, in accordance with law, as expeditiously as possible within the time period prescribed under Senior Citizens Act.
7. Since, notice has been directed to be issued to respondent No.6 further service of notice on respondent No.6 in this writ petition shall stands dispensed with and since, respondent Nos.4 and 5 are formal parties, no notice is required to be issued to respondent Nos.4 and 5 accordingly notice to respondent Nos.4 and 5 also stands dispensed with.
8. With the above direction, this Writ Petition is disposed of.
There shall be no order as to costs.
Miscellaneous petitions pending, if any, shall stand closed.
