ORDER:

The Writ Petition is filed seeking a writ, particularly in the nature of Mandamus, or any other appropriate writ to: i) declare the EPFO order dated 30.01.2025 and circular dated 18.01.2025 as illegal and set aside the same. ii) declare the petitioners’ eligibility for higher pension under Paras 11(3) & 11(4) of the EPS Scheme, 1995, in line with the Supreme Court judgment in EPFO vs B. Sunil Kumar. iii) direct the Respondents to release the higher pension from the date of retirement with interest and pass any other order deemed fit.

2. Heard Sri G.Vidya Sagar, learned Senior Counsel appearing for the petitioners and Sri G.Venkateshwarlu, learned Standing Counsel for EPFO, for respondent Nos.2 and 3. Perused the record.
