ORDER

Heard Sri Sardar Jasbeer Singh, learned counsel for the petitioner and Smt S.Sravanthi, learned Assistant Government Pleader for Stamps and Registration appearing for the respondent Nos.1 to 3. With their consent, this writ petition is disposed of at the stage of admission itself.

2. The case of the petitioner is that the petitioner’s father purchased the open plot admeasuring 250 Sq. Yards bearing Plot Nos.179, 180 and 181 in Sy.No.57 situated at Hasmathpet Village, Old Bowenpally Mandal, Ranga Reddy District, now Medchal-Malkajgiri District under a notarized Agreement of Sale-cum-General Power of Attorney (with possession) dated 28.03.1989 for a total consideration of Rs.40,000/-. After the demise of the petitioner’s father, the petitioner and his family members proposed to develop the said property for which they require the financial assistance from banks and the banker, after verification, insisted that the notarized Agreement of Sale be validated. The grievance of the petitioner is that when the said Agreement of Sale- cum-General Power of Attorney was submitted for validation by paying the necessary fees, the respondent No.3 refused to validate the same and directed to submit the Indemnity Bond, Sworn Affidavit and the copy of the death certificate.

Learned Assistant Government Pleader for Stamps and Registration appearing on behalf of the respondents would submit that the petitioner has not submitted any document as alleged in the Writ Petition and that, if the petitioner files the Agreement of Sale-cum- General Power of Attorney along with representation, the Registering Authority will consider the same in accordance with the provisions of the Indian Stamp Act, 1899 and the Rules made thereunder, for the purpose of validating the document.

In view of the said submissions, this Court deems it appropriate to dispose of the Writ Petition directing the petitioner to submit the Agreement of Sale- cum-General Power of Attorney (with possession) dated 28.03.1989 along with representation for validation and for collection of the deficit stamp duty under Sections 31, 32, 33, 41 and 42 of the Act, 1899 and if such document is presented, the respondent No.3 is directed to examine the same in accordance with the provisions of the Act, 1899 and in terms of the orders passed by this Court in W.P.No.38465 of 2022, dated 26.10.2022 and take appropriate action in accordance with law.

5. With the above observations, the Writ Petition is disposed of. There shall be no order as to costs.

6. Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
