ORDER

This Writ Petition is filed seeking the following relief:-

“…to issue appropriate writ, order or direction more particularly one in the nature of Writ of mandamus to declare the action of respondent NO.5 in issuing pattadar passbooks and title deeds for the purpose of registration of sale deeds in favour of third parties in respect of land admeasuring Ac.1.30 gutnas in Sy.No.174/LU/2; Ac.1.05 guntas in Sy.No.174/EE1; Ac.0.23 guntas in Sy.No.174/A; Ac.0.06 guntas in Sy.No.174/RUU/3; Ac.0.18 guntas in Sy.No.174/RU/2; Ac.0.36 guntas in Sy.No.174/RUU; Ac.0.18 guntas in Sy.No.174/RU/1; Ac.0.06 guntas in Sy.No.174/RUU/1; Ac.1.08 guntas in Sy.No.174/AA and Ac.1.05 guntas in Sy.No.174/E, situated at Indrakaran Village, Kandi Mandal, Sanga Reddy District (hereinafter referred to as “the subject land”), as illegal, arbitrary, ultravires and contrary to Articles 14, 21 and 300-A of the Constitution of India and against the provisions of the Stamps and Registration Act and against the principles of natural justice and consequently, direct respondent No.5 not to entertain any further registration of the subject land…”

2. Heard Sri K.R.K.Gargeya, learned counsel for the petitioner and Sri L.Ravinder, learned Assistant Government Pleader for Revenue appearing for the respondents and with their consent, this Writ Petition is being taken up for disposal at the admission stage.

Learned counsel for the petitioner would submit that respondent No.6 has entered into an agreement of sale, dated 16.11.2024 with the petitioner in respect of the land admeasuring Ac.1.30 guntas in Sy.No.174/LU/1, situated at Indrakaran Village, Kandi Mandal, Sanga Reddy District and half of the sale consideration ie., Rs.35.00 lakhs was paid by the petitioner and the remaining balance is agreed to be paid within three months from the date of agreement of sale. Learned counsel for the petitioner would further submit that, when the petitioner requested respondent No.6 to receive the balance sale consideration of Rs.35.00 lakhs and execute a registered sale deed, respondent No.6 did not come forward. Learned counsel for the petitioner would further submit that the unofficial respondents have made applications for issuance of pattadar passbooks and title deeds stating that they acquired the rights through Occupancy Rights Certificate, dated 16.07.2024 and they are also trying to alienate the subject land to third parties after obtaining pattadar passbooks in their favour. The grievance of the petitioner is that, if the unofficial respondents would obtain pattadar passbooks and alienate the subject property, he would suffer an irreparable loss. Hence, learned counsel for the petitioner prays this Court to pass appropriate orders.

Learned Assistant Government Pleader for Revenue would submit that the petitioner had purchased only a part of the land to an extent of Ac.1.30 guntas in Sy.No.174/LU/1 through an agreement of sale from respondent No.6 and not the entire subject land. He would further submit that the dispute between the petitioner and respondent No.6 is purely civil in nature and the petitioner ought to have approached the civil Court for specific performance of contract and instead of doing so, he approached this Court by filing the present writ petition. Hence, the Writ Petition is misconceived and prayed to dismiss the same.

As seen from the material placed on record, admittedly, respondent No.4 has granted Occupancy Rights Certificate, dated 16.07.2024 in respect of the subject land in favour of the unofficial respondents and the petitioner had purchased the land admeasuring Ac.1.30 guntas in Sy.No.174/LU/1 situated at Indrak
