ORDER
In this writ petition, the petitioner is challenging the action of respondents No.2 & 3 in attempting to demolish his house bearing No.1-61 consisting of three rooms and a shed roof with iron sheets with open land total admeasuring 1210 sq.yards in Sy.No.550/EE, situated at Mudireddipally Village, Rajapur Mandal, Mahabubnagar District, without any notice of demolition or order, as illegal and arbitrary and consequently to direction respondents No.2 & 3 not to demolish and interfere in the said property of the petitioner and pass such order or orders.
2. Heard the learned counsel for the petitioner, learned Government Pleader for Panchayat Raj appearing for respondents No.1 & 2, Sri K.Pradeep Reddy, learned Standing counsel for Gram Panchayat appearing for respondent No.3.

The petitioner submits that he is the owner of the land admeasuring 1210 sq.yards equivalent to 0-10 guntas in Sy.No.550/EE, situated at Muddireddipally Village, Rajapur Mandal, Mahbubnagar District and after obtaining permission from the authorities have constructed three rooms and cattle shed with iron sheets. Thereafter, when the petitioner wanted to make further construction, notices were issued and the petitioner has stopped further construction thereafter.

Learned counsel for the petitioner has drawn the attention of this Court to page No.26 of the writ papers to demonstrate that the permission was granted by the authorities earlier and also that the petitioner has been paying electricity charges from year, 2018 onwards and copies of the electricity bills are also placed at page No.29 of writ papers. He further submitted that respondents have also filed counter affidavit along with photographs of the building and stated that the building is an old building and the petitioner is not making any construction without obtaining any permission.
5. Learned Standing counsel relied on the averments of the counter affidavit and submitted that the petitioner is making construction without obtaining any permission.

Having gone through the rival contentions and material on record, this Court observes that the permission referred to by the petitioner appears to be the certified copy obtained from the Court of Junior Civil Judge at Jadcherla. It appears to be an old document. Further, electricity bills are of the year, 2019, therefore, if they are relating to the very same building, the building has to be considered as an old building. From the photographs also, the building appears to be an old building. However, petitioner undertakes that he will not make any further construction without obtaining permission from the authorities.

In view of the above, this Writ Petition is disposed of directing the petitioner not to make any further construction without obtaining permission and the respondents are also directed not to take any action against the old building without following the due process of law. There shall be no order as to costs. Miscellaneous applications, if any, pending in this Writ Petition, shall stand closed.
