2. Heard Mr.P.V.L.S. Sri Chakrpani, learned counsel representing Mr.Pulla Rao Yellanki, learned counsel for the petitioner, Mr.M.Srinivas, learned Assistant Government Pleader for Home appearing for respondents No.1, 3 to 6 and Mr.D.Edukondalu, learned Assistant Government Pleader for Home (A.P) appearing for respondents No.2 and 7.
3. Learned counsel for the petitioner submits that while the petitioner was transporting tobacco products from Karnataka State to Chhattisgarh State via public roads passing through certain districts in Telangana and Andhra Pradesh, the police intercepted the vehicle and registered a crime vide FIR No. 52 of 2018, without any lawful cause or justification. Hence, the petitioner prays for a direction to the respondents to permit the lawful transportation of goods and for quashment of the said crime.
4. Learned Assistant Government Pleader for Home submits that the said crime was subsequently taken cognizance of and numbered as C.C. No. 100434 of 2018 on the file of the learned Special Judicial Magistrate of First Class (Mobile) for trial of cases under the PCR Act-cum-II Additional Junior Civil Judge, Sangareddy. He further submits that, during the pendency of the proceedings as the petitioner herein admitted the charge, the case was disposed of with fine of Rs.6000/- and the petitioner paid the same. it is submitted that nothing further remains for adjudication, and therefore, the petition deserves to be dismissed.
5. I have perused the material placed on record.
6. The grievance of the petitioner is that respondents No. 1 and 2 interfered with the lawful transportation of tobacco products and registered a crime despite the petitioner holding a valid licence. However, the subsequent developments that transpired during the pendency of this petition clearly demonstrate that the proceedings in question have already been concluded as admitted and the petitioner has paid the fine imposed by the competent Court. That being the factual position, it is evident that nothing further remains for adjudication in this matter.
7. Accordingly, this Writ Petition is dismissed as infructuous.
There shall be no order as to costs.
Miscellaneous petitions, pending if any, shall stand closed.
