Order
Heard Mr. S.Goverdhan, learned counsel appearing for M/s. Nuthalapati Krishna Murthy, learned counsel for the petitioners; Mr. S.Rahul Reddy, learned Special Government Pleader attached to the office of the learned Additional Advocate General for the State of Telangana appearing for respondents No.1 and 2 and Mr. A.Raghuram, learned Assistant Government Pleader for the State of Andhra Pradesh appearing for respondent No.3.
2. Reference is made to this Court’s order dated 23.10.2025, which reads as under:
“Learned counsel Sri Nuthalapati Krishna Murthy appears for the petitioners.
Sri Santhapur Satyanarayana Rao, learned Government Pleader for Services-I, appears for respondent Nos.1 and 2.
Sri B.Rajeshwar Reddy, learned Government Pleader for the State of Andhra Pradesh, appears for respondent No.3.
The petitioners have approached this Court for implementation of the order passed by the learned Andhra Pradesh Administrative Tribunal at Hyderabad (hereinafter referred to as, “the Tribunal”)
in O.A.No.4291 of 2012, dated 20.06.2012.
The petitioners have got the benefit of the order passed by the learned Tribunal in O.A.No.1807 of 2012, which attained finality up to the Hon’ble Supreme Court in the Special Leave Petition preferred by the State on the challenge made to the judgment rendered by the combined High Court of Telangana and Andhra Pradesh in W.P.No.21086 of 2012. The said Special Leave Petition was disposed of on 18.11.2022 since similar petition i.e., SLP (C).No.16325 of 2016 was earlier dismissed on 11.07.2016. Thereafter, it appears that one or the other applicants have been approaching this Court for implementation of the order and consequent thereto, some Government Orders have also been issued, such as G.O.Rt.No.226, dated 23.05.2025, in favour of some of the applicants.
The petitioners have followed the suit in filing similar writ petition for implementation of the order.
We fail to understand as to when the issue has attained finality up to the Hon’ble Supreme court, why should individual applicants, who are covered by the original order passed by the learned Tribunal in O.A.No.1807 of 2012, be compelled to knock the doors of this Court for implementation of the order.
In that background, learned counsel for the respondents are allowed four weeks time to come out with instructions and if there are no legal hurdles, issue consequential orders for implementation of the decision rendered in the case of the petitioners also on similar lines.
Let the matter appear on 21.11.2025.
3. On the previous occasion i.e., 21.11.2025, on the submission of learned Special Government Pleader that the proceedings have been finalized, the matter was adjourned to enable the State to issue consequential orders.
4. Today, learned Special Government Pleader has produced Letter No.10410/E1/2025 dated 06.12.2025, issued by the Government of Telangana, Health, Medical and Family Welfare (E) Department and consequential Memo No.12262/B/E/2010 dated 06.12.2025 issued by the Department of Ayush whereby respondents No.1 and 2 have extended the pensionary benefits granted under G.O.Ms.No.226 H.M.& F.W.(E1) Dept., dated 23.05.2025 to the petitioners herein. The concerned officers have been requested to take necessary action and report compliance in the matter. Both the orders have also been received by the petitioners herein. Let these orders be taken on record.
5. Learned counsel for respondents No.1 and 2 submits that the grievance of the petitioners as regards implementation of order dated 20.06.2012, passed by the Andhra Pradesh Administrativ
