ORDER :

This writ petition is filed by the petitioner to declare the action of respondent Nos.1 to 4 in not providing water supply connection pursuant to the application in File No.2023-11-1814 dated 13.11.2023 for his Plot No.29, Annapoorna Society, Mahindra Hills, Malkajgiri, Hyderabad, as being illegal and arbitrary.

2. Heard Mr. S. Maruti Rao, learned counsel for the petitioner, and Mr. A. Veeresh Kumar, learned standing counsel for the Hyderabad Metropolitan Water Supply and Sewerage Board (HMWS & SB).

3. The petitioner claims to be absolute owner and possessor of the Plot No.29, Annapoorna Society, Mahindra Hills, Malkajgiri, Hyderabad. He constructed house in the subject property by obtaining permission from the GHMC. The residential house was completed in the year 2023. The petitioner made application seeking fresh domestic water connection in the subject property to HMWS & SB by paying requisite fees on 15.11.2023 in File No.2023-11-1814. It is stated that the petitioner submitted all requisite documents sought for by respondent authorities. However, water connection was denied to the petitioner on

02.12.2023 citing feasibility issues.

Learned counsel for the petitioner submitted that the petitioner was not communicated any reasons for refusing water connection to the subject property nor any report was furnished to the petitioner explaining the basis for which water connection is denied. The petitioner also lodged complaint before the Prajavani grievance cell, in pursuance of which the officials visited his property, but no action was taken. Further, the adjacent and neighbouring land owners of the petitioners have been granted water connections, which are being serviced by the HMWS & SB. On 11.03.2025, the petitioner issued legal notice to respondents seeking upon them to grant water connection to his property. Despite the same, there is no action on the part of respondent authorities, as such, the petitioner is constrained to approach this Court.

5. Learned standing counsel for HMWS & SB submitted that the application of the petitioner in File No.2023-11-1814 dated 15.11.2023 will be considered, and orders will be passed, in accordance with law.

Recording the aforesaid submission of learned standing counsel for HMWS & SB, the writ petition is disposed of, directing respondent Nos.1 to 4, to consider the application of the petitioner in File No.2023-11-1814 dated 15.11.2023 seeking water connection to his property bearing Plot No.29, Annapoorna Society, Mahindra Hills, Malkajgiri, Hyderabad, and pass orders, in accordance with law, by affording opportunity of hearing to him, within a period of four (4) weeks from the date of receipt of a copy of this order. There shall be no order as to costs.

As a sequel thereto, miscellaneous applications, if any, pending in the writ petition stand closed.
