With the consent of both parties, this Writ Petition is taken up for disposal at the admission stage itself.

2. This Writ Petition is filed under Article 226 of the Constitution of India, seeking the following relief:

“…to issue a writ or order or direction more particularly one in the nature of a writ of Mandamus, declaring the action of the respondents in not considering the petitioner’s promotion to the post of Junior Assistant, in the Vocational Government junior college or Government Junior College, though the petitioner has requisite qualification, long service of 33 years, who got regularized as Lab Attendant, under GO.Ms.No.24 dated 20.07.2022, further not acting upon the petitioner’s representation dated 03.09.2025, which is pending with the respondents 1 to 3, is arbitrary, illegal and contrary to the principles of natural justice and violation of the Article 16 and 21 of the constitution of India, consequently direct the respondents 1 to 3, to act upon the petitioner’s representation dated 03.09.2025 and hold that the petitioner is entitled for the promotion to the post of Junior Assistant in the Government Junior College, and pass…”

3. Heard Smt.Y.L.Sivakalpana Reddy, learned counsel for the petitioner and learned Government Pleader for Services-I for the respondents.

Learned counsel for the petitioner submits that the petitioner was appointed as a Lab Attendant in respondent No.4- College vide proceedings dated 19.10.1992 in the vocational stream on a consolidated remuneration of Rs.650/- per month. After completing 33 years of service, the petitioner’s services were regularized vide proceedings dated 20.07.2022 and though he is eligible for promotion to the post of Junior Assistant, the respondents are not his considering, either in regular or vocational colleges. As such, the petitioner submitted a representation dated 03.09.2025 requesting the respondents to consider his case for promotion to the post of Junior Assistant in any of the regular or vocational Government Junior Colleges in Nalongda District against available vacancies. However, no action has been taken by the respondents so far. Therefore, learned counsel prays that this Court to direct the respondents to consider the petitioner’s representation dated 03.09.2025 and pass appropriate orders, within a time-frame to be stipulated by this Court.

5. Learned Government Pleader appearing for the respondents submits that as per G.O. Ms. No.79, Higher Education (IE.1) Department, dated 25.11.2002, there is no provision for promotion to the post of Junior Assistant from the cadre of Lab Attendant. Nonetheless, the respondents will consider the petitioner’s representation dated 03.09.2025 and pass appropriate orders in accordance with law.

Having regard to the submissions made by learned counsel for the respective parties and without going into the merits of the case, this Writ Petition is disposed of, directing the respondents to pass appropriate orders on the representation dated 03.09.2025 submitted by the petitioner, strictly in accordance with law, as expeditiously as possible, preferably within a period of six (6)

weeks from the date of receipt of a copy of this order and communicate a copy of the decision to the petitioner.

Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs.
