THE HONOURABLE SRI JUSTICE N.TUKARAMJI
S. V. Bharat Reddy – Appellant

The State of Telangana – Respondent
WP 30694/2018
IN THE HIGH COURT FOR THE STATE OF TELANGANA AT HYDERABAD THE HONOURABLE SRI JUSTICE N.TUKARAMJI WRIT PETITION No.30694 OF 2018
01st December, 2025 Between:
S.V. Bharat Reddy. … Petitioner AND The State of Telangana, Rep., by its Principal Secretary, Home Department and 8 others. … Respondents
O R D E R:
This Writ Petition is filed under Article 226 of Constitution of India seeking the following relief/s:-
“…to issue an appropriate Writ, Order or Direction more particularly one in the nature of Writ of Mandamus declaring the arrest of the petitioner in Cr.No.438/2018 on the file of 4th respondent as being illegal, arbitrary and violation of Articles 14 and 21 of the Constitution of India and initiate appropriate action against Respondent Nos.5 to 9 as per the law laid down by the Hon’ble Supreme Court, Consequently direct the Respondents to pay damages of Rs.5 lakhs to the petitioner and pass…”
2. Heard Ms. S.Ashritha Rao, learned counsel representing Mr. Vijay Ashrit, learned counsel for the petitioner on record and Mr. D.Pradeep, learned Assistant Government Pleader for Home appearing for respondent Nos.1, 2 and 4.
3. Learned counsel for the petitioner submits that, assailing the arrest of the petitioner in Crime No. 438 of 2018 registered by respondent No. 4, the present petition has been filed seeking appropriate directions.
4. Learned Assistant Government Pleader for Home submits that the said crime was duly investigated, and upon completion of the investigation, a charge sheet was filed, which was taken on file as C.C. No. 1793 of 2018 on the file of the Court of the II Additional Junior Civil Judge-cum-II Additional Judicial Magistrate of First Class, Kushaiguda. It is further submitted that, after due trial, the matter culminated in conviction, and the accused was sentenced to six months’ simple imprisonment and a fine of Rs.10,000/- vide judgment dated 20.04.2022. Hence, the contention raised by the petitioner is without merit, and the learned Assistant Government Pleader prays for dismissal of the petition.
5. I have perused the material available on record.
6. The grievance of the petitioner is that he was illegally arrested in connection with Crime No. 438 of 2018. However, the developments reported by the learned Assistant Government Pleader for Home clearly establish that, following due investigation, a charge sheet was filed, and after a full-fledged trial, the proceedings resulted in conviction. In light of these developments, the contention of the petitioner that his arrest was illegal and arbitrary is unfounded. Since the matter has already culminated in conviction, nothing further remains for consideration in this petition.
7. Accordingly, this Writ Petition is dismissed as infructuous.
There shall be no order as to costs.
Miscellaneous Petitions, pending if any, shall stand closed.
