ORDER:

This Criminal Petition is filed by the petitioner-accused seeking to quash the proceedings in FIR No.2324 of 2025 on the file of Gachibowli Police Station, Cyberabad, registered for the offences under Sections 69 and 89 of BNS.

2. Heard Sri Mohd. Abdul Rasheed, learned counsel for the petitioner and Sri E. Ganesh, learned Assistant Public Prosecutor for the respondent No.1-State.

Learned counsel for the petitioner has submitted that the petitioner and the de facto complainant were in consensual relationship and that the petitioner never made any promise of marriage to attract the offences under Section 69 of BNS. He further submitted that the WhatsApp messages exchanged between the petitioner and the de facto complainant would elicit the consensual relationship between the parties. Thus, the allegations levelled against the petitioner are false and that both of them got separated in the month of April 2025, but the de facto complainant has filed the present complaint with all false allegations just to harass the petitioner. He, therefore, prayed to quash the proceedings against the petitioner.

Learned Assistant Public Prosecutor has submitted that allegations in the complaint point out that the petitioner made a promise of marriage and sexually exploited the victim and has got her aborted once and further has threatened her stating that he would share her nude photographs to others, if she reveals the same to others. He further submitted that the investigation is still in progress and prayed to dismiss the petition.

6. The contents of the complaint point out that the petitioner and the de facto complainant used to work in the same office. Though they belong to different religions, the petitioner promised her that he would take care of the religious obligations. The de facto complainant took some time to accept his proposal, but after few days she started believing him. Thereafter, he convinced her and developed physical acquaintance with her and whenever she expressed her fear, he used to beat her. When de facto complainant developed pregnancy, the petitioner got her aborted and asked her to resign her job if she wants him to marry her and with that hope, she resigned her job at Cognizant, but then also he refused to marry her. Therefore, she lodged the complaint. The allegations point out prima facie case against the petitioner herein under Section 69 of BNS. The investigation is still in progress and the truth is yet to be unraveled. Hence, no relief can be granted to the petitioner at this juncture and the petition is liable to be dismissed.

7. Accordingly, the Criminal Petition is dismissed.

Miscellaneous Petitions, pending if any, shall stand closed.
