O R D E R:

This Writ Petition is filed under Article 226 of Constitution of India seeking the following relief/s:-

“…to issue a Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondent No.3 in seeking to adjudicate Civil dispute between the petitioners and the respondent No.4 and in assisting the respondent No.4, activities as against the petitioners, as the same is without jurisdiction, quite arbitrary and opposed to fundamental rights and to further direct the respondent No.3 not to intervene in the said dispute in possession of the said house bearing No. 8-3-699/10/11 and 8-3-699/10/11/A, Jayaparakashnagar, Yellareddyguda, Hyderabad and pass…”

2. Heard Mr. J.Suresh Babu, learned counsel appearing for the petitioners and Mr. D.Pradeep, learned Assistant Government Pleader for Home appearing for respondent Nos. 1 to 3.

Learned counsel for the petitioners submits that respondent No. 3 has been interfering in the civil disputes pending between the petitioners and respondent No. 4, and has also been disturbing the petitioners’ possession of their residential properties bearing House Nos. 8-3-699/10/11 and 8-3-699/10/11/A, Jayaprakashnagar, Yellareddyguda, Hyderabad.

Accordingly, the present writ petition has been filed seeking appropriate directions restraining the respondent police authorities from interfering either in the petitioners’ possession or in the civil disputes between the parties.

4. Learned Assistant Government Pleader for Home submits that the allegations of interference by the respondent police authorities are baseless and unfounded. It is contended that the police have not interfered in the civil disputes between the petitioners and respondent No.4. However, based on the representations received from both sides, Crime No. 11 of 2018 was registered on the representation of respondent No. 4, and three other crimes have been registered against the petitioners, all of which are under investigation. Except for actions taken in connection with these crime proceedings, the police authorities have not interfered in any civil disputes between the parties. It is therefore prayed that the petition be dismissed as devoid of merit.

5. I have perused the material available on record and considered the respective submissions of counsel.

6. The grievance of the petitioners is that respondent No. 3 has been interfering in the civil disputes between the petitioners and respondent No. 4, and has also attempted to disturb their possession over the aforementioned house properties.

Having regard to the stand of the respondent police authorities and keeping in view the limitations on police intervention in matters of civil nature, this Court deems it appropriate to reiterate that police authorities have no role to play in private civil disputes relating to title, ownership, or possession of immovable property, except to the extent required for maintaining public order and tranquility.

Accordingly, respondent No. 3, as well as the other respondent police authorities are directed to refrain from interfering in any manner with the civil disputes between the petitioners and respondent No. 4, including with respect to the petitioners’ possession over the properties bearing House Nos. 8-3-699/10/11 and 8-3-699/10/11/A, Jayaprakashnagar, Yellareddyguda, Hyderabad.

9. It is, however, clarified that any action taken by the respondent police authorities strictly in accordance with law, and in the course of investigation or proceedings in connection with registered crimes, shall remain unaffected by this order.

10. With the above observations and directions, the writ petition stands disposed of. There shall be no order as to costs.

Miscellaneous Petitions, pending if any, shall stand closed.
