ORDER:

This Transfer Criminal Petition is filed with a prayer to transfer DVC.No.31 of 2024 pending on the file of the learned II Additional Judicial Magistrate of First Class, at Nizamabad, to any court of law within the territorial jurisdiction of Hyderabad.

2. Heard Sri Avaneesh Naraparaju, learned counsel for petitioners, and Sri K. Venumadhav, learned counsel for respondent No.2.

Learned counsel for the petitioners submitted that DVC No.31 of 2024 has been filed by Respondent No.2 with false and omnibus allegations to harass petitioners, though the marriage of respondent No.2 with petitioner No.1 was solemnized on 21.08.2021 and she voluntarily left the matrimonial home on 07.10.2023, later coercing Petitioner No.1 into signing an agreement under duress which was repudiated by legal notice dated 30.04.2024. Despite the willingness of Petitioner No.1 to continue marital life, Respondent No.2 lodged a false criminal case and thereafter filed the present DVC.
