ORDER:

In this writ petition, the petitioner is challenging the action of the respondent authorities in trying to lay the drainage pipe line through the petitioner’s agricultural land in Sy.Nos.507E/2, 5070/1, 5070/1A, 5070/1, 5070/B admeasuring Ac.0.14½ gts, Ac.0.07½ gts, Ac.0.07½ gts, Ac.0.14½ gts and Ac,0.04 gts., total admeasuring Ac.0.29½ gts., and Ac.00.18½ gts., situated at Elgedu Village and Mandal, Peddapalli District, without any authority or jurisdiction and consequently direct the respondent authorities not to take coercive steps without following due process of law.

Heard the learned counsel for the petitioner, learned Government Pleader for Roads & Buildings appearing for respondents No.1 & 3, learned Government Pleader for Revenue appearing for respondent No.2 and Sri K.Pradeep Reddy, learned Standing counsel for Gram Panchayat appearing for respondents No.4 & 5.

According to the petitioner, the respondents are trying to lay the drainage pipe line through his agricultural land without paying any compensation, without acquiring the same and also without following due process of law. Therefore, he seeks a direction from this Court preventing the respondents from doing so.

Learned Government Pleader for Roads & Buildings appearing for respondent No.3 has forwarded the written instructions received by him, according to which, there is an existing culvert of 1 diametre just away 60m from the households and that the petitioner has submitted that he has no objection to take up the culvert work after 13.11.2025. However, the culvert work has not yet started. A copy of the undertaking or no objection given by the petitioner is also furnished before this Court.

5. Learned counsel for the petitioner, however, submitted that no objection was given by the petitioner only to take action in accordance with law and not for laying the pipe line through his land.

Having regard to the rival contentions and material on record, this Court finds that respondents intend to lay the pipeline in the place of existing culvert and that the land allegedly belongs to Panchayat Raj Department and if the respondents intend to widen the same, beyond the road area, then they may have to take recourse to law before laying the pipe line in the private land of the petitioner.

7. In view of the same, the respondents are directed to measure the road and to proceed with laying of drainage pipe line within the Road Area of the PR road only.

8. Accordingly, this Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous applications, if any, pending in this writ petition stand closed.
