ORDER:

This Criminal Petition is filed by the petitioner-accused seeking to quash the order dated 11.09.2025 in CrlM.P. No.1013 of 2025 in SC Spl.No.429 of 2018 on the file of Fast Track Special Judge for trial and Disposal of Rape and POCSO Act Cases, Ranga Reddy District at L.B. Nagar, wherein the petition filed by the petitioner under Section 311 Cr.P.C., to recall PWs.1 and 2 was dismissed.

2. Heard Sri J. Vishnu Vardhan, learned counsel for the petitioner and Sri Jithender Rao Veeramalla, learned Additional Public Prosecutor for the respondent No.1.

The learned counsel for the petitioner has submitted that the defence counsel before the trial court failed to put some relevant questions while cross-examining the witnesses i.e. PWs.1 and 2 on the earlier occasion and therefore, the accused filed a petition under Section 311 Cr.P.C. for recalling the said witnesses and that the trial court ought to have given an opportunity to recall the said witnesses for further cross-examination, but it has dismissed application erroneously.
