THE HONOURABLE SRI JUSTICE E.V.VENUGOPAL WRIT PETITION No.31612 of 2025

ORDER:

Aggrieved by the inaction of respondent Nos.2 to 4 in not consider the petitioners’ representation and in continuing the illegal entry of respondent No.5 in the revenue records of Survey No.398, Potaram Village, Mallial Mandal, Jagtrial District, the present writ petition is filed. A consequential prayer is sought to direct the official respondents to cancel the patta passbook standing in the name of resondent No.5 and to effect mutation of the petitioners’ names in respect of Ac.1-03½ guntas in Survey No.398 of Potaram Village, Mallial Mandal Jagtial District.

2. Heard learned counsel for the petitioner and Mr. L.Ravinder, learned Assistant Government Pleader for Revenue appearing for respondent Nos.1 to 4.

Learned counsel for the petitioners submitted that the petitioners were the absolute owners and possessors of the agricultural land admeasuring Ac.1-03½ guntas in Survey No.398 of Potaram Revenue Village, Mallial Mandal, Jagtial District, having purchased the same from one Narsayya. On request of the petitioners, the said Narsayya expressed his readiness to execute pattas in their favor. To their utter surprise, the name of said Narsayya was no longer found in the revenue records. On verification, it was found that the name of said Narsayya was found up to the year 2006. Subsequent to that, the name of respondent No.5 is being reflected in the revenue records and contended that the same was illegally entered without any valid basis. It is further submitted that on 17.10.2020, a panchayat was held, wherein the respondent No.5 clearly admitted that he would hand over the said land to the petitioners. Despite such admission, the respondent No.5 is interfering with them pertaining to the said property and causing harassment. Due to the inaction of official respondents in rectifying the revenue records, the petitioners were deprived of their legitimate benefits such as Rythu Bandhu, etc., and were put to serious financial loss and irreparable hardship. Left with no other option, the petitioners were constrained to file this writ petition seeking appropriate directions to official respondent Nos.2 to 4 to act upon their representation dated 29.01.2025.

Learned Assistant Government Pleader for Revenue submitted that the dispute raised by the petitioners pertains to title and ownership over the subject land, and such issues cannot be adjudicated in the writ petition. Therefore, any request for cancellation of the patta passbook standing in the name of respondent No.5 or for effecting mutation in favor of the petitioners can be considered by the authorities only upon production of appropriate orders or decrees from a Competent Civil Court. Hence, prays that the petitioners may be directed to approach the Civil Court for appropriate relief, instead of approaching this Court by filing the present writ petition.

This Court, having heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue, is of the view that the relief sought by the petitioners involves disputed questions of fact relating to title and ownership over the subject land. As such, any correction, cancellation or mutation of entries in the revenue records can be carried out by the revenue authorities only on the basis of valid orders passed by a competent Civil Court.

6. In view of the above, the petitioners are directed to approach the competent Civil Court, seeking appropriate remedies as available under law.

7. With the above directions, this writ petition is disposed of. There shall be no order as to costs.

As a sequel thereto, miscellaneous applications if any pending, in this petition, shall stand closed.
