JUDGMENT

This appeal is filed by the appellant-Insurance Company, challenging the order and decree dated 14.11.2019 in M.V.O.P.No.354 of 2017 on the file of Motor Accidents Claims Tribunal-cum-Principal District Judge at Nizamabad (hereinafter "the Tribunal" for brevity).

2. The brief facts of the case are that on 24.07.2017 at about 5:30 P.M., the driver of the tractor bearing No.AP-25-AH-2829 (hereinafter "crime vehicle" for brevity) drove the vehicle in a rash and negligent manner with high speed and dashed one Besta Gangaram (deceased). As a result, the deceased fell down and the rear wheel of the tractor ran over him, due to which, the deceased sustained multiple grievous injuries and was shifted to Government Area Hospital, Kamareddy and for further treatment to NIMS Hospital. However, he succumbed to injuries while undergoing treatment on 30.07.2017. Thereafter, a case in Crime No.116 of 2017 of Lingampet Police Station was registered for the offence under Section 304-A IPC.
