O R D E R:

This Writ Petition is filed under Article 226 of Constitution of India seeking the following relief/s:-

“…to issue a Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the Notice No. LAO/A4/08/2018 dt. 23.07.2018 issued by 3rd respondent in rejecting considering the application of 7th respondent dt. 12.04.2018 for NOC without applying the guidelines/norms issued by 6th respondent vide No. RW/NH-33023/19/99-DO-III, dt. 24.07.2013 and also not considering the representation of the petitioners dt. 06.06.2018 as being illegal, arbitrary, discriminatory, violative of Art. 14 and 19(1) (g) of the Constitution of India and set aside the same and consequently direct 3rd respondent to consider the said application by applying the guidelines/norms issued by 6th respondent and pass…”

2. Heard Mr.Vivek Jain, learned counsel appearing on behalf of the petitioners and Mr.D.Pradeep, learned Assistant Government Pleader for Home appearing for respondent Nos.1 to 3.

3. Learned counsel for the petitioners submits that the present application has been filed seeking appropriate directions on the ground that respondent No. 7 issued the No Objection Certificate without adhering to the guidelines and norms prescribed by respondent No. 6.

4. Learned Assistant Government Pleader for Home submits that the No Objection Certificate was issued in the year 2018, strictly in accordance with the applicable norms and guidelines. Hence, the contention raised by the petitioners does not survive for consideration.

5. I have perused the material available on record.

6. Having regard to the prayer of the petitioners and considering the lapse of time, this Court finds no ground to interfere with the issuance of the No Objection Certificate by respondent No. 7. However, liberty is reserved to the petitioners to avail appropriate remedies available under law, if the cause still survives.

7. Accordingly, this Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions, pending if any, shall stand closed.
