IN THE HIGH COURT FOR THE STATE OF TELANGANA AT HYDERABAD
THE HONOURABLE SRI JUSTICE K. SARATH
A.Padma – Appellant
Versus
The State of Telangana – Respondent
WP 30616/2025

HON'BLE SRI JUSTICE K.SARATH

ORDER:

Heard Sri N. Praveen Reddy, learned counsel for the petitioner and the learned Assistant Government Pleader for Stamps and Registration appearing for the respondent Nos.1 to 6. With their consent, this Writ Petition is disposed of at the stage of admission itself.

2. This Writ Petition is filed to declare the inaction of the respondents in not deleting the land in Sy. No.42 situated at Boduppal village, Medipally Mandal, Medchal-Malkajgiri District from the prohibited list of properties of Boduppal village maintained by the respondents under Section 22-A of the Registration Act, 1908, as illegal, arbitrary and contrary to Addendum to Wakf Properties published in the Andhra Pradesh Gazette No.19, dated

07-05-2009.

3. Learned counsel for the petitioner submits that the properties were initially declared as Wakf property as per the Andhra Pradesh Gazette Notification No.6-A dated 09-02-1989 as mentioned in Serial No.2744. Subsequently, on 07-05-2009, the Government issued Addendum to the said Notification dated 09-02-1989 correcting the survey number as Sy. No.52 instead of Sy. No.42. However, despite this correction, the respondents have continued to include the subject properties in the prohibited list without properly verifying the documents submitted by the petitioner. As a result, the petitioner is unable to sell away the subject properties.

4. Learned counsel for the petitioner further submits that the petitioner has made a representation on 03-09-2025 to the respondent Nos.2, 3 and 5 to delete the reference of land in Sy. 42 from the prohibited list maintained with the Stamps and Registration Department and in spite of the same, the respondent Nos.2, 3 and 5 are not taking any action on the said representation.

5. On the other hand, the learned Assistant Government Pleader for Stamps and Registration appearing for the respondent Nos.1 to 6 submits that the respondent Nos.2, 3, and 5 will consider the representation made by the petitioner and pass appropriate orders in accordance with law, in due course, and requested to pass appropriate orders. 6. Having regard to the submissions made on either side, without going into the merits of the case, the present writ petition is disposed of directing the respondent Nos.2, 3, and 5 to consider the representation dated 03-09-2025 filed by the petitioner and pass appropriate orders in accordance with law, within eight (08) weeks from the date of receipt of a copy of this order and communicate the same to the petitioner. There shall be no order as to costs.

7. As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
