ORDER:

Heard learned Counsel for the petitioner and learned Assistant Government Pleader for Stamps and Registration appearing for the respondents and perused the material on record.

Learned Counsel for the petitioner submits that the petitioner is questioning the action of the respondent No.3 in not receiving the Sale Deed presented by the petitioner in respect of the land in Sy.No.10, admeasuring 1500 square yards, situated at Guttala Begumpet, Serilingampally Mandal, Ranga Reddy District, on the ground order dated 08.11.2023, passed in I.A.No.1119 of 2023 in O.S.No.158 of 2023 on the file of VI Additional District and Sessions Judge, Kukatpally as illegal and arbitrary and the said I.A.No.1119 of 2023 in O.S.No.158 of 2023 was dismissed by the concerned Court on 02.07.2025. In spite of that the respondents are not entertaining the document presented by the petitioner for registration.

Learned Counsel for the petitioner further submits that they have filed Memo vide USR No.124292 of 2025 by filing order of VI Additional District and Sessions Judge, Kukatpally passed in I.A.No.1119 of 2023, 1120 of 2023 and 1121 of 2023 in O.S.No.158 of 2023, dated 02.07.2025 and the said IAs were dismissed by the Trial Court. In view of the same, no order for prohibiting the registration of the document of the petitioner for the suit schedule property.

4. On the other hand, learned Assistant Government Pleader for Stamps and Registration is not disputing with the submissions made by the learned Counsel for the petitioner with regard to the disposal of the I.A.No.1119 of 2023, 1120 of 2023 and 1121 of 2023 in O.S.No.158 of

2023, dated 02.07.2025 and further submits that the petitioner without presenting document has approached this Court seeking registration of the document. If the petitioner presents the same before the Registering authority, the respondents will receive the same, process the registration and follow the procedure or pass orders as contemplated under Section 71 of the Registration Act, 1908.

In view of the submission made by both sides, the writ petition is disposed of by directing the petitioner to present the document and the Registering Authority is directed to receive, register and release the document presented by the petitioner for the suit schedule property, subject to the petitioner complying with the provisions of the Act, 1908 as well as the Indian Stamp Act, 1899 by duly taking into account of the order dated 02.07.2025 passed by the VI Additional District and Sessions Judge, Kukatpally in I.A.No.1119 of 2023, 1120 of 2023 and 1121 of 2023 in O.S.No.158 of 2023. It will be open to the Registering Authority to refuse the document presented before him, if he has any other objection, by duly assigning reasons in support of such decision and communicate the said decision to the petitioner. It is made clear that this Court has not expressed any opinion on merits of the case as to the entitlement of the petitioner to get the subject document registered. There shall be no order as to costs.

6. Miscellaneous petitions, if any, pending shall stand closed.
