ORDER:

This Civil Revision Petition is filed seeking a direction to the learned II Additional Senior Civil Judge, Karimnagar, to take up and dispose of O.S. No.54 of 2017 expeditiously and in accordance with law.

2. Heard Ms. C. Jyotsna Devi, learned counsel representing Mr. S. Satish, learned counsel for the petitioner, and perused the material on record.

3. Learned counsel for the petitioner submits that the present revision is filed being aggrieved by the inaction of the trial Court in keeping O.S. No.54 of 2017 pending without adjudication. He submits that the petitioner instituted the said suit seeking partition and separate possession. It is contended that despite the filing of the written statements by the defendants, the suit has remained stagnant without progress, thereby causing serious prejudice to the petitioner’s rights and interests. Learned counsel therefore prays that appropriate directions be issued to the trial Court to dispose of the suit within a stipulated period.

4. I have considered the submissions made and examined the record.

5. Having regard to the facts of the case, it is evident that O.S. No.54 of 2017, which pertains to partition and separate possession, has been pending since 2017 despite the completion of pleadings. Considering the prolonged pendency of the matter and the petitioner’s grievance that the inaction of the trial Court is prejudicial to his interests, this Court is of the opinion that the suit requires prioritization for early disposal.

6. Accordingly, the trial Court is directed to take up O.S. No.54 of 2017 on a priority basis and dispose of the same on its merits and in accordance with law, as expeditiously as possible, preferably within a period of four (04) months from the date of receipt of a copy of this order. There shall be no order as to costs.

7. With the above direction, this Civil Revision Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions, pending if any, shall stand closed.
