O R D E R

In this Writ Petition, the petitioners are challenging the proceedings dt.04.11.2025 issued by respondent No.5 blacklisting the petitioner agro industries.

2. The grievance of the petitioners is that no notice is given to the petitioners prior to such blacklisting. According to the petitioners, there is no misappropriation of funds or mis-utilisation of CMR paddy by the petitioner agro industries. The learned counsel for the petitioners placed reliance upon the orders of this Court in W.P.No.9803 of 2022 dt.25.02.2022 and also in W.P.No.14370 of 2025 dt.02.05.2025 in support of the proposition that the petitioners should be given an opportunity of hearing before passing any order of blacklisting.

3. Learned Government Pleader for Civil Supplies and the learned Standing Counsel for respondent Civil Supplies Corporation are also heard. They submitted that there was a report against the petitioners, on the basis of which, the impugned action has been taken against the petitioners.

4. After hearing both the parties, this Court finds that there is clear violation of principles of natural justice in this case. It is apparent that no notice was given to the petitioner agro industries before blacklisting it. The impugned order also refers only to discreet enquiry conducted by the authorities about the irregularities in paddy procurement at DCMS, Narsingapur-Maddulapally PPC of Mancherial District during Rabi 2024-25. It does not appear that the report of the discreet enquiry also has been furnished to the petitioners and any explanation has been called for from them.

5. Learned Government Pleader for Civil Supplies has also forwarded a copy of the written instructions received by him which also do not refer to any notice issued to the petitioners before passing the impugned order of blacklisting.

6. In view of the above, this Court is inclined to set aside the impugned order dt.04.11.2025 with liberty to the respondents to follow the due process of law if they intend to pass any order against the petitioners.

7. The Writ Petition is accordingly disposed of. No order as to costs. 8. Pending miscellaneous petitions, if any, in this Writ Petition shall stand closed.
