ORDER:

This Writ Petition is filed with the following relief:

“…to issue a Writ, or Order, or Direction more particularly one in the nature of Writ Of Mandamus declaring the action of the respondent police in not conducting proper investigation on the complaint of the petitioner dt.31-03-2018 which attracts the penal provisions of cheating, kidnap, rape, wrongful confinement, criminal intimidation, criminal conspiracy against the unofficial respondents as arbitrary, illegal, unwarranted, uncalled for and in violation of Articles 14 and 21 of the Constitution of India and consequently direct the respondent police to conduct proper investigation in Crime No.4/2018 dt.03- 01-2018 on the file of the 4th respondent police station and to pass.…”

2. None appeared on behalf of the petitioner.

3. I have heard Mr.M.Srinivas, learned Assistant Government Pleader for Home appearing for respondent Nos.1 to 4.

4. Learned Assistant Government Pleader for Home submits that after due investigation in Crime No. 4 of 2018, a final report was filed endorsing the matter as ‘action dropped.’ Hence, nothing further remains for consideration in the present writ petition.

5. I have perused the material on record.

6. The petitioner submitted a representation alleging cheating, kidnapping, rape, and wrongful confinement of her daughter.

However, the material on record reveals that the missing girl was approximately 20 years old and had voluntarily left for Patna along with one Prakash Kumar Bharati. She also filed Miscellaneous Case No. 9607 of 2018 before the Chief Judicial Magistrate, Nalanda, Bihar, against the petitioner’s husband/her father. The investigation further discloses, on the basis of her statement, that being a major, she had left of her own volition.

7. Having regard to these facts and the conclusion reached by the investigating agency in filing the final report, it is evident that no further orders are warranted in this matter.

8. Accordingly, this writ petition is dismissed as infructuous.

There shall be no order as to costs.

Miscellaneous Petitions, pending if any, shall stand closed.
