ORDER

This writ petition is filed seeking following prayer:-

“to issue an appropriate Writ, Order or Direction more particularly one in the nature of Writ of Mandamus to declare the action of the respondent authorities in proposing to disburse the compensation amount to the unofficial respondents in lieu of acquisition of the lands in Sy.Nos.9/4/EE, 9/18/EE, 9/19/EE, 9/20/EE, 9/36/EE, 12/EE and 5/AA admeasuring 1.17 gts, Ac.1.18 gts, Ac.1.17 gts, Ac.1.03 gts, Ac.2.00 gts, Ac.1.00 gts and Ac.1.38 gts total admeasuring Ac.10.07 gts situated at Thimmaipally village and Annojiguda villages of Kandukur Mandal, RR District, in spite of the written representations dt 3.11.2025 and 7.11.2025 informing about the pendency of the suit OS No.08 of 2024 and subsistence of the injunction orders in IA No.13 of 2024 dt 24.12.2024 and presently transferred and renumbered as OS No.503 of 2025 on the file of the Senior Civil Judge Maheshwaram as being illegal, arbitrary, unjust and unconstitutional.”

2. Brief facts of the case are that the petitioner’s father was the owner and possessor of agricultural lands in Sy.Nos.9/4/EE, 9/18/EE, 9/19/EE, 9/20/EE, 9/36/EE, 12/EE and 5/AA, admeasuring Ac.1.17 guntas, Ac.1.18 guntas, Ac.1.17 guntas, Ac.1.03 guntas, Ac.2.00 guntas, Ac.1.00 guntas, and Ac.1.38 guntas total admeasuring Ac.10.07 guntas situated at Thimmaipally and Annojiguda villages of Kandukur Mandal, RR District, and after his death, the said lands devolved upon the petitioner and respondent Nos.5, 6 & 7, and are not yet partitioned. Respondent Nos.5 and 6, who are brothers of the petitioner, made attempts to alienate the said lands to the third parties, as such, the petitioner instituted suit bearing O.S.No.8 of 2024 on the file of the Principal Senior Civil Judge, R.R.District (presently transferred and renumbered as O.S.No.503 of 2025 on the file of the Senior Civil Judge, Maheshwaram), seeking partition and separate possession, and the trial Court vide order dated 24.12.2024 in I.A.No.13 of 2024 in O.S.No.8 of 2024 granted ad-interim injunction restraining respondent Nos.5 to 7 from alienating the said lands till disposal of the main suit. The petitioner submitted representations 03.11.2025 and 07.11.2025 before respondent No.4 bringing to the notice about the injunction order granted by the trial Court, and thereafter, respondent No.4 uploaded the said lands in the dispute register. The main grievance of the petitioner is that the respondent authorities have proposed to acquire the said lands, and in spite of the representations informing about the pendency of the said suit and subsistence of injunction order dated 24.12.2024, the respondent authorities are proceeding to disburse the compensation amount in favour of the unofficial respondents. Questioning the same, the present petition is filed.

3. Mr. Somu Srinivas Reddy, learned Assistant Government Pleader for Land Acquisition appearing for respondent Nos.1 to 4, placed instructions of LAO/Revenue Divisional Officer, Kandukur Division, wherein it is stated that after issuing the compensation amount to respondent No.6, the petitioner has filed an objection petition on 03.11.2025 before the LAO/RDO, Kandukur, with a request not to entertain any type of transactions such as registrations or any type of compensation in respect of the above said lands till disposal of main suit in O.S.No.8 of 2024. After receiving the said objection petition filed by the petitioner, the cheque issued to respondent No.6 has been kept on hold and the said objection petition is under enquiry, and after completion of enquiry the compensation will be paid to the eligible rightful owners.
