ORDER

This writ petition is filed seeking the following prayer:

“…declaring the action of the respondents in not consider the petitioner’s representation dated 15.04.2023 as being illegal, arbitrary in not considering the petitioner’s representation dated

15.04.2023 as being illegal and arbitrary…”

2. Heard learned counsel for the petitioners and learned Assistant Government Pleader for Revenue appearing on behalf of respondent Nos.1 to 4. With their consent, this writ petition is taken up for disposal. Notice to respondent Nos.5 to 7 is hereby dispensed with.

The facts of the case in brief as stated are that petitioner claims to be owners of H.Nos.2-106 and 3-77 within the limits of Valour Village, Jadcherla Mandal, Mahabubnagar District having inherited the same from ancestors. The above said houses were submerged in palamuru Ranga Reddy Drift Irrigation Scheme, Ugandaour Balancing Reservoir at Udandapur Village, Jadcherla Mandal. Earlier when there was disputes between petitioners and respondent Nos.5 to 7, petitioners filed a suit in O.S.No.81/2019 on the file of Junior Civil Judge, Jadcherla.

Subsequently, the suit was amicably settled between petitioners and respondent Nos.5 to 7. Accordingly, the suit was referred to Lok Adalat vide Case No.227/2022 and award was passed affirming the claim that petitioners and respondent Nos.5 to 7 were to get equal share in the suit schedule property and respondent Nos.5 to 7 were set exparte. The said judgement and decree has become final. It is submitted respondent Nos.5 to 7 are illegally attempting to claim the compensation amount. In that regard, petitioners have filed representation dated 15.04.2023 to the respondent authorities. However, the same has not been considered till date. Questioning the same, the present writ petition is filed.

4. Though various grounds are raised in the writ petition, learned counsel for the petitioners restricts their prayer seeking a direction to respondent authorities to dispose of the petitioner’s representation dated 15.04.2023 in a time bound period.

Learned Assistant Government Pleader for Land Acquisition appearing on behalf of respondents submits that if the said representation is still pending for consideration, the respondent authorities may be directed to dispose of the petitioner’s representation, dated 15.04.2023 and pass appropriate orders in accordance with law.

In view of the submission made by the learned counsel on either side and without going into the merits of the case, this writ petition is disposed of directing the respondent authorities to dispose of the petitioner’s representation, dated 15.04.2023 by considering the Lok Adalat Award dated 12.11.2022 and pass appropriate orders strictly in accordance with law, as expeditiously as possible, preferably within a period of six (06) weeks from the date of receipt of a copy of this order by giving a fair opportunity of hearing to the petitioner and all the concerned parties.

7. Accordingly this writ petition is disposed of.

Miscellaneous applications, if any pending, shall stand closed. However, there shall be no order as to costs.
