ORDER

This Criminal Petition is filed under Section 528 Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) by the petitioner/accused seeking to quash the proceedings against him in Crime No.36 of 2024 on the file of Jubilee Hills Police Station, Hyderabad District, registered for the alleged offence punishable under Section 381 of Indian Penal Code, 1860 (for short ‘IPC’).

2. Heard Mr.Narsimulu, learned counsel for the petitioner and Mr.Jithender Rao Veeramalla, learned Additional Public Prosecutor appearing for the respondent No.1.

3. Though this petition is filed for quashing the proceedings in the crime, during the course of arguments, learned counsel for petitioner has sought for directions to the Police to proceed with investigation by issuing notice under Section 35(3) of BNSS (Previously Section 41-A of Cr.P.C.).

4. The learned Additional Public Prosecutor submitted that the alleged offence is theft, and the stolen property is gold, none of which has been recovered so far. He further submitted that CCTV footage has been collected and the petitioner is suspected to have committed the theft at
