ORDER

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Home appearing for respondent Nos.1 to 4. With their consent, this writ petition is being taken up for disposal. 2. This writ petition is filed seeking the following relief:

“…to issue a writ order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of the 1st and 2nd Respondents in not constitution and appointing the Special Public Prosecutor in S.C. No. 187 of 2022 in Crime no. 144 of 2016 of P. S. Mulugu on the file of Additional Senior Civil Judge-cum-Additional Assistant Sessions Judge at Sangareddy to elicit the truth for just decision of prosecution case to save and secure Criminal Justice and petitioner/victim personal life and liberty being endangered by the offenders 6^th to 8^th Respondents and their men continuous organized crimes, registered before 3rd and 4th Respondents, pending trial on account of malicious investigation conducted by the 5th to shield the offenders by planting the agents of offenders as independent witness and tampered the Criminal Justice by creating fear of life in the eyes of victims, witnesses pending investigation and deprived by fair trail to restrain from adducing the best available evidence, as is illegal, arbitrary, unconstitutional and violative of Fundamental Rights under Article 14, 19(1)(g) 21 and Directive Principles of state under Article 39A of the Constitution of India and consequently, direct the 1st and 2nd Respondent to constitute and appoint Special Public Prosecutor in S.C.No.187 of 2022 in Crime No.144 of 2016 of P.S. Mulugu on the file of Additional Senior Civil Judge-cum-Additional Assistant Sessions Judge, Sangareddy and also direct the 3rd and 4th Respondent to provide protection to secure the life of the victims, witness and subject Scene of Offence properties pending criminal trail and pass…”

Today when the matter has been taken up for hearing, learned Government Pleader for Home has submitted that there are two cadres of Public Prosecutors in Sanga Reddy and any one among such two cadre of Public Prosecutors will be appointed to pursue S.C.No.187 of 2022 arising out of Crime No.144 of 2016 of P.S. Mulugu pending on the file of learned Additional Senior Civil Judge-cum-Additional Assistant Sessions Judge, Sangareddy.

In that view of the matter, this writ petition is disposed of with consent directing the respondent authorities to appoint the Public Prosecutor to pursue S.C.No.187 of 2022 arising out of Crime No.144 of 2016 of P.S. Mulugu, pending on the file of learned Additional Senior Civil Judge- cum-Additional Assistant Sessions Judge, Sangareddy, within a period of (03)

weeks from the date of receipt of copy of this order.

5. With these observations, this writ petition is disposed of with consent.

Miscellaneous applications, if any pending, shall stand closed. No order as to costs.
