Heard Mr. Nayakwadi Ramesh, learned counsel for the petitioner; Ms.M.Shalini, learned Government Pleader for Services-II, learned counsel appearing for respondent No.1 and Mr.Harender Pershad, learned Senior Counsel appearing for Mr.A.Naren Rudra, learned Standing Counsel for respondent Nos.2 to 4 and perused the record.

2. The instant is the writ petition which has been filed assailing the order dated 02.04.2025 by which the respondents have terminated the services of the petitioner with immediate effect from

02.04.2025 F.N. itself.

3. The brief facts relevant for the adjudication of the present dispute is that a notification was issued for direct recruitment to the post of Office-Subordinate vide Notification No.6/2023, dated 02.01.2023. The qualification prescribed in the said notification reads as under:

“ a) Must have passed any exam between 7^th to 10^th class or its equivalent examinations. But the candidate who is having higher qualifications that 10^th class shall not be considered as eligible.

b) The applicants have to state in their online application, the professional skills then have, such as cooking, carpentry, plumbing, electrical and paintings etc., for the purpose of performing duties with respect of their professional skills at the residence of judicial officers.”

4. The petitioner participated in the said selection process and was found meritorious. Thereupon, the respondents issued the order of appointment in favour of the petitioner on 02.01.2024. Based upon which, the petitioner joined the employment and started working with the respondents.

5. Subsequently, vide the impugned order dated 02.04.2025, abruptly the services of the petitioner stood terminated with immediate effect on 02.04.2025 itself. The reason assigned for passing of the order of termination has been reflected in the impugned order, which reads as thus:

“For the reason that they possess higher qualification than prescribed, which was the qualification for appointment to the post of Office Subordinate under the Recruitment Notification No.06/2023, dt.02.01.2023 and they suppressed the fact of their having higher qualification in all four occasions i.e., in their online application, in their self declaration form, in their attestation form and also during re-verification of their original Certificates in this Office on 31.05.2024, as the fact of their having higher qualification was registered by themselves in the website of Telangana State Public Service Commission, Group-IV Services.”

The basis for passing the aforesaid order was the so-called higher qualification reflected in the website of Telangana Public Service Commission (TPSC), Group-IV services, where, in the recruitment process by TPSC, the petitioner while filling up the form said to have been filled up column showing to have been appeared in the 10+2 course at Inter C.E.C. and in the year of clearing the said course is reflected as 8/2015. Apart from the said information that is reflected in the website, there does not seem to be any other material, which the respondents either collected or enquired or got it verified. The petitioner also had made a detailed representation to the respondents on 06.06.2025 narrating the entire factual matrix of the case and his qualifications specifically envisaging that he does not possesses higher qualification than having 10^th passed. Having passed the said 10^th examination in May, 2012, he does not possess any higher qualification. He further submits that the petitioner in fact appeared in the 12^th standard through Telangana Open School Society in May, 2015. However, he could not pass the said examination and thus has not acquired any higher qualification than the S.S.C. till date.
