ORDER

Heard Sri S. Surender Reddy, learned counsel for the petitioner and Sri B.Arjun Rao, learned counsel representing Ms. Bethamcharla Sai Haritha, learned counsel appearing for respondent.

2. Respondent had filed a suit in O.S.No.160 of 2018 on the file of the Principal Junior Civil Judge at Warangal, against the petitioner herein/defendant seeking perpetual injunction in respect of open plot No.78 admeasuring 300 sq.yards in Sy.No.1029 situated at Madikonda Village, Kazipet Mandal, Warangal Urban District (hereinafter referred to as ‘subject property’), restraining the petitioner herein/defendant from interfering with the possession of the respondent/plaintiff over the subject property. Along with the said suit, the petitioner herein had filed I.A.No.193 of 2018 seeking ad interim injunction.

3.It is the specific contention of the petitioner herein that he has filed a caveat and without even putting the petitioner on notice, learned trial Court on 14.03.2018, learned trial Court directed the petitioner herein to maintain status quo. Therefore, the petitioner herein has filed I.A.No.997 of 2018 in I.A.No.193 of 2018 seeking to grant status – quo – ante directing the plaintiff to remove the illegal constructions made by her after 14.03.2018 in the subject property.

4. The said suit was transferred to I Additional Senior Civil Judge – cum – I Additional Assistant Sessions Judge, Hanumakonda and re-numbered as O.S.No.766 of 2025 and the said interlocutory applications were re-numbered as I.A.No.531 and 532 of 2025, respectively.

5. During the pendency of the said suit, respondent/plaintiff had filed I.A.No.573 of 2025 in O.S.No.766 of 2025 under Order VII Rule 14 of CPC, to receive the following additional documents which are specifically mentioned in the application:-

1) House Construction Permission, dated 15.04.2018, 2) Copy of property tax assessment for H.No.30-02-1151/4 along with payment receipts all dated 31.07.2018, 3) Copy of property tax assessment for the said house along with latest tax payment receipt dated 18.05.2019, 4) Copy of property tax assessment for the said house along with latest tax payment receipt dated 21.05.2020, 5) Copy of property tax assessment for the said house along with latest tax payment receipt dated 12.04.2021, 6) Property tax payment receipt for the said house, dated

16.05.2023 and

7) Property tax payment receipt for the said house dated

01.04.2025.

The petitioner herein/defendant filed counter opposing the said application contending that he is the absolute the owner and possessor of the land admeasuring 300 sq.yards in Sy.No.1030/B situated at Madikonda Village, Kazipet Mandal, Warangal Urban District. Respondent is claiming that she is the absolute owner and possessor of the suit schedule property basing on the registered sale deed bearing document No.19/1993 dated 02.01.1993 and in the cause title, she mentioned her age as 37 years and by the date of said document, she was 12 years only, therefore, it is a sham document. Basing on the said interim order dated 14.03.2018, respondent/plaintiff proceeded with the construction and filed aforesaid documents. The petitioner herein/defendant also requested the learned trail Court to decide the aforesaid two interlocutory applications vide I.A.Nos.531 and 532 of 2025 first, thereafter, the present application i.e. I.A.No.573 of 2025. Without considering the same, vide impugned order dated 02.07.2025, learned trial Court allowed the said application and received the said documents. Challenging the said order, the petitioner herein filed the present revision.

7. Perusal of the record would reveal that the respondent herein/plaintiff filed the aforesaid suit against the petitioner herein/defendant seeking perpetual injunction.
