THE HON’BLE SRI JUSTICE N.V.SHRAVAN KUMAR Writ Petition No.17920 of 2025 This writ petition is filed seeking the following prayer:

“…declaring the action of Respondent No 3 in rejecting the Petitioners application for grant of Arms Licence vide order dated 03.05.2025 bearing No.HW3/Arms/2376/2021 without assigning any reasons whatsoever as being wholly arbitrary, illegal, ultra vires the Arms Act, 1959 and violative of the petitioners fundamental rights guaranteed under Articles 14 and 21 of the Constitution of India besides being in gross violation of the principles of natural justice and set aside the same and consequently direct Respondent No.3 to reconsider the application of the petitioner for grant of Arms Licence in strict accordance with the provisions of the Arms Act

2. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Home appearing on behalf of respondents. With their consent, this writ petition is taken up for disposal.

The facts of the case in brief as stated are that petitioner is a businessman and that on 08.01.2024, when the petitioner was inspecting one of his properties, he was targeted and physically attacked by one Mr.Prashanth Reddy by pelting stones against petitioner’s vehicle and caused bodily harm endangering petitioner’s life. The petitioner lodged a complaint before Pahadi Shareef Police Station and FIR No.14 of 2024 dated 08.01.2024 has been registered on the accused persons. It is further submitted that petitioner is having no criminal antecedents and there is no case pending against him. As such, petitioner sought for an Arms License before respondent No.3 under the provisions of Arms Act, 1959 solely for the purpose of protecting himself. However, respondent No.3 rejected the application of the petitioner vide impugned order dated 03.05.2025 without assigning any reasons whatsoever.

Questioning the same, the present writ petition is filed.

Learned counsel for the petitioner further draws attention of this Court to a Memo dated 25.04.2025 annexed along with the counter affidavit whereby the Joint Commissioner of Police requested the Deputy Commissioner of Police, West Zone, Hyderabad to issue speaking order of rejection and inform the applicant accordingly.

5. On a perusal of the impugned order dated

03.05.2025, though reference was made to the Memo dated 25.04.2025, respondent No.3 has not issued any speaking order of rejection. As such, this Court is of the considered view that impugned rejection order dated 03.05.2025 is bereft of any reasons and no speaking orders have been passed giving reasons for rejection.

6. In that view of the matter, the impugned order dated 03.05.2025 is hereby set aside and the matter is remanded back to respondent No.3 for fresh consideration. Accordingly, this writ petition is disposed of directing respondent No.3 to pass appropriate speaking order either granting or rejecting the application of the petitioner for grant of Arms License substantiating appropriate reasons.

7. With the above observations, this writ petition is disposed of.

Miscellaneous petitions, pending, if any, shall stand closed. However, there shall be no order as to costs.
