ORDER:

Heard Sri V.T. Kalyan, learned counsel appearing on behalf of the petitioner, and the learned Assistant Government Pleader for School Education appearing on behalf of the respondents.

2. The petitioner approached this Court seeking the prayer as under:

“…to issue a Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus declaring the impugned proceedings L. Dis. No. 272 / UMC / 2024, dated 07-01-2024 and 29-03-2025 wherein the respondents has rejected the case of the petitioner for correction of the Date of Birth as 08-05- 2008 as illegal, arbitrary and set aside the same by directing the respondents to correct the date of birth of the petitioner in the SSC memo and pass….”

3. The case of the petitioner in brief as per the averments made by the petitioner in the affidavit filed by the petitioner in support of the present writ petition is as under:

i) The petitioner’s son, Master Bonasi Kumara Swamy who is a minor studied in various schools at Nagarkurnool and completed SSC in March 2024 from TSWRS, Bijinepally. During the SSC Board Examinations, the petitioner came to know that the petitioner’s son’s Date of Birth was incorrectly recorded as 17.06.2006 in the school records and hall ticket, instead of the correct date of birth i.e., 08.05.2008.

ii) Immediately, the petitioner approached the District Educational Officer, Nagarkurnool, i.e., Respondent No.3 who in turn recommended the correction of the date of birth to the Director of School Education, Telangana i.e., Respondent No.2. However, the Respondent No.2 rejected the request vide proceedings Dis.No.272/UMC/2024 dated 07.01.2025 and 29.03.2025, stating that all school records show the petitioner’s son’s date of birth as 17.06.2006, without taking into consideration of the fact that the correct date of birth of the petitioner is recorded as 08.05.2008 in the Birth Certificate, Community Certificate, Aadhaar Card, Bonafide Certificate of Sangamithra School, and other documents. Aggrieved by the action of the respondents, the petitioners filed the present writ petition.

PERUSED THE RECORD (A) The relevant portion of the order impugned passed by the respondent No.2- the Director, School Education, Telangana, Hyderabad vide proceeding L.Dis No.272/ UMC/ 2024 dated 07.01.2025 pertaining to the subject issue of correction of date of birth of the petitioner addressed to the respondent No.3 i.e., the District Education Officer, Nagarkurnool is extracted hereunder “The attention of the District Educational officer, Nagarkunool is invited to the reference read above, wherein he has submitted the proposals for correction of date of birth in the SSC memo bearing Roll. No. 2428100770/March, 2024 in respect of Bonasi Kumara Swamy, S/o Bonasi Laxmaiah Ex- Student of TSWRS (B), Bijinepally, Bijinepally (M), Nagarkurnool District.

Further, after verification of the proposals submitted by the District Educational Officer, Nagarkurnool in all the records pertaining to the candidate the date of birth is recorded as 17.06.2006 and the same was concluded by the Mandal Educational Officer, Bijjanpally, Nagarkurnool District. And it is a parental mistake, as per the orders issued in the G.O.Ms.No.1263 Edn. Dept., Dt: 06.05.1961, the correction cannot be carried out.

Therefore, the District Educational Officer, Nagarkurnool is directed to inform the same to applicant and return the Original SSC Memo to the candidate through Principal concerned through speed post with acknowledgement due for record purpose.

Further, the District Educational Officer, Nagarkurnool is instructed to verify such proposal with existing procedure and rules thoroughly before submitting to this office.

Hence, the original SSC Pass memo bearing Roll. No. 2428100770/March, 2024 is here with enclosed.”
