ORDER

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Home appearing for respondent Nos.1 to 5. With their consent this writ petition is taken up for disposal at the admission stage itself.

2. This writ petition is filed seeking following prayer:-

“…declaring the interference by respondents with the business activity of the petitioner as illegal, arbitrary and violative of Articles 14, 19 (1) (g) and 21 of the Constitution of India and direct the respondents not to interfere with the operation of ‘Flakeured Hookah’ services in the petitioner’s café, subject to compliance with the COTP Act, 2003, the Prohibition of Smoking in Public Places Rules, 2008...”

The facts of the case in brief as stated are that petitioner is running a Café under the name and style of “the Silver Spoon Cafe” situated at premises No.2-22-262, Terrace Space, Madhapur, Telangana under the jurisdiction of respondent No.5.
