ORDER:

This Writ Petition is filed seeking the following prayer:

“…to issue a writ, order or direction, more particularly a writ of Mandamus declaring the actions of the respondents for wasting of water from the tank “Ootsarangapalli Cheru Mallanna Gutta.” Without diverting it to standing banana crop on petitioner’s agricultural land in Sy.No.102 and 108, situated at Ootpallay Village of Bejjur Mandal, Adilabad District, are illegal, arbitrary, ultra vires, null and void, and against the principles of natural justice and in violation of fundamental and constitutional rights of the petitioner, in the interest of justice and equity...”

2. Heard Mr.Mohammed Rahail Ahmed, learned counsel for petitioner and learned Assistant Government Pleader for Irrigation appearing for respondent Nos.1 and 2.

3. It is the case of petitioner that he owns an extent of Acs.7.00 gts. of land in Survey Nos.102 and 108 of Ootpallay Village, Bejjur Mandal, Adilabad District. That he has been cultivating the said extent with water drawn from a tank known as “Ootsarangapalli Cheru Mallanna Gutta.”
