THE HON’BLE SHRI JUSTICE ANIL KUMAR JUKANTI CIVIL REVISON PETITION No.3812 OF 2025

ORDER:

This Civil Revision Petition is filed seeking a direction to the Principal Junior Civil Judge, Narayanpet, to expedite and dispose of O.S.No.469 of 2022 within a time frame.

2. Heard J.Sham Sundar, learned counsel for revision petitioner. None appears for respondent.

3. Learned counsel for revision petitioner submitted that revision petitioner filed O.S.No.154 of 2021 for perpetual injunction on the file of Junior Civil Judge, Athmakur, and due to the reorganization of districts, O.S.No.154 of 2021 was transferred to the Court of Principal Judicial Civil Judge, Narayanpet, and renumbered as O.S.No.469 of 2022. It is further submitted that in spite of lapse of four years, trial has not commenced and requested this Court to direct the trial Court to dispose of the suit expeditiously by fixing a time frame. It is also submitted that time frame of six months be fixed to dispose of O.S.No.469 of 2022 on the file of Principal Junior Civil Judge, Narayanpet.

4. The Apex Court in SLP (Criminal) Diary No.30839 of 2021, in a similar case, wherein a direction was sought to the trial Court to expedite the proceedings in S.C.No.627 of 2017 and conclude the trial within six months, held as follows:

“Looking to the nature of the order passed by the High Court, we are not inclined to grant leave to appeal in this matter but feel impelled to observe that ordinarily, before passing any such order for expeditious proceedings in a particular case (which might appear to be rather of innocuous nature), it would be appropriate for the higher Court to appreciate that any such order for one case, without cogent and extremely compelling reasons, might upset the calendar and schedule of the subordinate Court; might result in assigning an unwarranted priority to that particular case over and above other cases pending in that Court; and progression of such other cases might suffer for no reason and none of the faults of the litigants involved therein.”

5. In view of the law laid down by the Apex court, no cogent or extremely compelling reasons have been brought before the Court to appreciate the relief sought for in this Civil Revision Petition.

6. Be that as it may, this Court is of the considered opinion that without disturbing the progression of other cases pending before the Principal Junior Civil Judge, Narayanpet, O.S.No.469 of 2022 be taken up and disposed of expeditiously.

7. With the above observations, the Civil Revision Petition is disposed of. No order as to costs.

Miscellaneous applications pending, if any, shall stand closed.
