Heard Mr. R. Eshwar Chander, learned counsel for the petitioner, and Mr. K. Ravi Mahender, learned standing counsel for the GHMC, appearing for respondent Nos.2 to 4.

Learned standing counsel for the GHMC placed on record written instructions, show-cause notice dated 13.05.2025, speaking order dated 05.06.2025 and notice dated 18.10.2025 issued under Section 461-A of the Greater Hyderabad Municipal Corporation Act 1955 (for short ‘GHMC Act’). It is submitted that show-cause notice vide Notice No.UC-10442/W-123/CIR-24/TPS/GHMC/2025 dated 13.05.2025 has been issued by respondent No.3 to respondent Nos.5 and 6 stating that unauthorized construction has been made in the second (2nd floor) over the existing Cellar + Ground + one (1) upper floor in the premises bearing H.No.1-2-33/P-83/1 situated at Prashanth Nagar, Hyder Nagar, Kukatpally, and they were directed to appear for personal hearing on 30.05.2025 at 03:00 P.M. However, respondent Nos.5 and 6 neither submitted reply to the show-cause notice nor appeared for personal hearing. As such, speaking order vide Notice No.UC-10442/W-123/CIR-24/TPS/GHMC/2025 dated 05.06.2025 was passed by respondent No.3 directing respondent Nos.5 and 6 to remove unauthorized construction in the subject property within a period of fifteen (15) days. Subsequently, respondent No.3 addressed letter to respondent No.4 vide Lr.No.UC- 10442/W-123/C-24/TPS/KPZ/GHMC/2025 dated 17.10.2025 stating that concerned NAC engineer has inspected the subject property and found some deviations, hence the Nodal Officer, Kukatpally Zone, was requested to take necessary action for demolishing the unauthorized construction made in the subject property. Later, notice dated 18.10.2025 under Section 461-A of the GHMC Act was issued intimating respondent Nos.5 and 6 that unauthorized construction will be sealed by respondent - GHMC authorities.

3. Learned standing counsel for the GHMC further submitted that unauthorized construction made by respondent Nos.5 and 6 in the subject property will be sealed and thereafter appropriate action will be taken for demolition of the same.

Recording the aforesaid submissions of the learned standing counsel for the GHMC, the writ petition is disposed of, directing respondent - GHMC authorities to implement the speaking order vide passed by respondent No.3 Notice No.UC-10442/W-123/CIR-24/TPS /GHMC/2025 dated 05.06.2025 and notice issued under Section 461-A of the GHMC Act and seal the unauthorized construction made by respondent Nos.5 and 6 in the property bearing H.No.1-2-33/P- 83/1 situated at Prashanth Nagar, Hyder Nagar, Kukatpally, within a period of four (4) weeks from the date of receipt of a copy of this order.

5. As this order is passed without entering into the merits, notice to respondent Nos.5 and 6 is dispensed with. However, if respondent Nos.5 and 6 are aggrieved by this order, they are at liberty to approach this Court seeking modification of this order. There shall be no order as to costs.

As a sequel thereto, miscellaneous applications, if any, pending in the writ petition stand closed.
