ORDER :

This criminal petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) by the petitioner/A.4 seeking anticipatory bail in the event of his arrest in connection with FIR No.173 of 2025 of Kodad Rural Police Station, Suryapeta District. The offences alleged against the petitioner are under Sections 137 (2), 64(2) r/w.49 of Bharatiya Nyaya Sanhita, 2023.

2. Heard Sri Karunakar Reddy, learned counsel for the petitioner and Sri D. Arun Kumar, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

3. As seen from the remand report the offence alleged against this petitioner is under Section 137 (2) of BNS for which the punishment prescribed is seven years, without going into merits of the case, this Court deems it appropriate to direct the petitioner to appear before the Investigating Officer on or before 03.11.2025 between 11:00 a.m. and 05:00 p.m. and in turn the Investigating Officer is directed to follow the procedure laid down under Section 35 (3) of BNSS and also the guidelines formulated by the Hon’ble Supreme Court in Arnesh Kumar v.
