THE HON’BLE SMT.JUSTICE TIRUMALA DEVI EADA CRIMINAL PETITION No.13362 of 2025 ORDER:-
1. This Criminal Petition is filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 seeking to quash the proceedings against the petitioner/accused in C.C.No.1833 of 2019, on the file of the learned II Additional Junior Civil Judge-cum-XIII Additional Judicial Magistrate of First Class, Ranga Reddy District at Rajendranagar, registered for the offences under Section 79 of Juvenile Justice Act and Section 14 of Child Labour Act and Sections 16 & 17, 18 of Bonded Labour Act, 1975.
2. Heard Sri Shaik Shareef, learned counsel for the petitioner/accused as well as Sri Jitender Rao Veeramalla, the learned Additional Public Prosecutor appearing for the respondent No.1-State.
3. When the matter is taken up for hearing, learned counsel for the petitioner has restricted his prayer seeking a direction to the learned Magistrate for expeditious disposal of C.C.No.1833 of 2019 pending on the file of the learned II Additional Junior Civil Judge- cum-XIII Additional Judicial Magistrate of First Class, Ranga Reddy District at Rajendranagar and also to dispense with the appearance of the petitioner before the Trial Court.
4. The learned Additional Public Prosecutor submitted that appropriate orders may be passed.
5. Perused the record. The allegations leveled against the petitioners pertain to the offences under Section 79 of Juvenile Justice Act and Section 14 of Child Labour Act and Sections 16 & 17, 18 of Bonded Labour Act, 1975. C.C.No.1833 of 2019 is pending on the file of the learned II Additional Junior Civil Judge- cum-XIII Additional Judicial Magistrate of First Class, Ranga Reddy District at Rajendranagar. Truth or otherwise of the said allegations can be brought out during the course of trial. This Court is not inclined to interfere with the judicial process.
6. Hence, the Criminal Petition is disposed of directing the learned Trial Court to dispose of C.C.No.1833 of 2019 at the earliest, preferably within a period of six (6) months, in view of the circular instructions granted by the High Court to prioritize disposal of matters pending for more than 5 years. However, the presence of the petitioner/accused before the Trial Court is dispensed with provided that the petitioner is represented through an Advocate on every date of hearing and that he shall be present before the Trial Court whenever he is specifically required during the course of trial.
7. Miscellaneous petitions pending, if any, shall stand closed.
