IN THE HIGH COURT FOR THE STATE OF TELANGANA AT HYDERABAD
THE HONOURABLE SRI JUSTICE N.TUKARAMJI
G. Urmila devi. – Appellant
Versus
. The State of Telangana – Respondent
WP 22998/2017
ORDER:
This Writ Petition is filed under Article 226 of Constitution of India seeking the following relief:
“…pleased to issue a Writ Order or Direction more in the nature of Writ of Mandamus direct the respondents to take cognizance by considering all those intact documentary evidences by filing FIR against, with appropriate sections, and prosecute the accused, on the file of the ACP Cyber Crime Police Station, Nampally and Station House Officer, Trimulgherry Police Station and pass…”
2. None appears for the petitioner.
3. Heard Mr. M.Srinivas, learned Assistant Government Pleader for Home appearing for respondents.
4. Learned Assistant Government Pleader submits that basing on the representation, Crime No.196 of 2017 was registered and after due investigation, a final report was filed on 24.03.2018 classifying the matter as ‘mistake of fact’ on the file of the learned XII Additional Chief Metropolitan Magistrate, Hyderabad. Therefore, the contention raised by the petitioner does not survive for consideration.
5. I have perused the materials on record.
6. Having regard to the contention of the petitioner seeking a direction to the respondents for taking cognizance by taking all documentary evidence and registering a crime and to prosecute the accused and the developments reported by the learned Additional Government Pleader and considering the fact that a final report has been filed way back in 2018, this Court is of the considered view that nothing further survives in this matter for consideration.
7. Accordingly, as the grievance of the petitioner has been effectively addressed by the respondent, this Writ Petition is dismissed as infructuous. However, the rights of the petitioner are reserved to avail appropriate remedies before the Court concerned, if cause still survives. There shall be no order as to costs.
Miscellaneous Petitions, pending if any, shall stand closed.
