IN THE HIGH COURT FOR THE STATE OF TELANGANA AT HYDERABAD
THE HONOURABLE SMT JUSTICE RENUKA YARA
Kuthadi Induja @ Singaram Padma – Appellant
Versus
Kuthadi Ramesh – Respondent
TRCMP 234/2025

THE HON’BLE SMT. JUSTICE RENUKA YARA Tr.C.M.P.No.234 of 2025

ORDER:

Heard Sri T.Basavaiah, learned counsel appearing for the petitioner and Sri Anugu Sangeeva Reddy, learned counsel appearing for the respondent.

2. This Transfer Civil Miscellaneous Petition is filed under Section 24 of the Code of Civil Procedure, 1908, by the petitioner- wife to transfer H.M.O.P.No.52 of 2025 pending on the file of the learned Senior Civil Judge at Kamareddy, Kamareddy District, to the file of the learned Judge, Family Court-cum-Principal Senior Civil Judge at Siddipet, Siddipet District.

3. Learned counsel for the petitioner submitted that the petitioner is the wife of the respondent and she is residing with her patents house at Narsapur Village, Siddipet District and respondent is residing at Ashok Nagar Colony, Kamareddy Town and District. Learned counsel further submitted that it is difficult for the petitioner to travel from Narsapur to Kamareddy to defend the said HMOP and that DVC and MC cases are pending before the Courts at Siddipet.

4. Learned counsel for the respondent opposed the transfer of HMOP and submitted that transfer is an issue to be considered on the basis of facts and circumstances of the case, which are unique to each case, and in that regard, reliance is placed on the judgment of the Hon’ble Supreme Court reported in Krishna Veni Nagam vs. Harish Nagam1, Delma Lubna Coelho vs Edmond Clint Fernandes2 and Neeta Kumari vs Sanjay Kumar (Tr.Petition (Civil) No.2466 of 2024), whereunder certain guidelines were issued for adjudication of matrimonial disputes by utilizing the facilities such as videoconferencing.

5. Currently, such advanced facilities are not available in all the Districts. In view of the same, and having regard to the social and financial status of the petitioner-wife, who is a household lady, so as to facilitate her to defend the HMOP, H.M.O.P.No.52 of 2025 stands transferred from the file of the learned Senior Civil Judge, Kamareddy, to the file of the learned Judge, Family Court-cum- Principal Senior Civil Judge, Siddipet. The Court concerned is hereby directed to transmit the entire case file relating to H.M.O.P.No.52 of 2025, after duly indexed, within a period of one month from the date of receipt of a copy of this order, under intimation to the other side.

6. Accordingly, the Transfer Civil Miscellaneous Petition is allowed. No costs.

Miscellaneous petitions pending, if any, shall stand closed.
