ORDER:
Heard Sri T.Bala Mohan Reddy, learned counsel appearing for the petitioner and Sri Jaysurya Vishnu Vardhan, learned counsel for the respondent.
2. This Transfer Civil Miscellaneous Petition is filed under Section 24 of the Code of Civil Procedure, 1908, by the petitioner-wife to transfer F.C.O.P.No.498 of 2024 pending on the file of the learned Principal Family Court Judge, City Civil Court, Secunderabad, to the file of the Family Court-cum-Additional District Judge, Karimnagar 3. Learned counsel for the petitioner represented that the petitioner, along with her son, is residing at Karimnagar with her old aged parents, who are daily wage labourers. It is pleaded that the transfer of FCOP to Karimnagar is necessary for the petitioner to defend herself.
4. Learned counsel for the respondent submitted that in the FIR lodged under Section 498-A of IPC, the petitioner mentioned her residential address at Chappal Bazar, Kachiguda, Amberpet, Hyderabad and though she is residing at Chappal Bazar, the petitioner is seeking transfer only to harass the respondent.
5. A perusal of the record shows that the petitioner was served with notices in all the proceedings at her Karimnagar address.
6. Keeping in view the convenience of the petitioner and to enable her to defend F.C.O.P., the relief sought by the petitioner is granted by transferring F.C.O.P.No.498 of 2024 from the file of the learned Principal Family Court Judge, City Civil Court, Secunderabad, to the file of the Family Court-cum-Additional District Judge, Karimnagar 7. Accordingly, the Transfer Civil Miscellaneous Petition is allowed. F.C.O.P.No.498 of 2024 stands transferred from the file of the learned Principal Family Court Judge, City Civil Court, Secunderabad, to the file of the Family Court-cum-Additional District Judge, Karimnagar District. The Court concerned is hereby directed to transmit the entire case file relating to F.C.O.P.No.498 of 2024, after duly indexed, within a period of one month from the date of receipt of a copy of this order, under intimation to the other side. No costs.
Miscellaneous petitions pending, if any, shall stand closed.
