ORDER:

W.P.No.25985 of 2025:

In this writ petition, the petitioner is seeking a writ of mandamus declaring the action of the respondent No.2 in not approving the cancellation of memberships of respondent No.3/Karimnagar Cooperative Urban Bank Limited approved by its resolution dated 04.08.2025, as illegal and arbitrary and consequently to set aside the same and direct the respondent No.2 to approve and implement the cancellation of memberships of respondent No.3 and to submit the final voter list after excluding the terminated members from the list in accordance with law and the Memo dated 18.08.2025 issued by the petitioner herein and to pass such other order or orders in the interest of justice.

W.P.No.30309 of 2025:

This writ petition is filed by the petitioners herein, whose membership has been terminated by the petitioner in W.P.No.25985 of 2025 vide proceedings dated 04.08.2025 and 08.08.2025 issued by the respondent No.5 and the proceedings dated 19.09.2025 issued by the respondent No.3 as illegal, arbitrary and consequently to set aside the same and to pass such other order or orders in the interest of justice.

2. Learned counsel for both the parties reiterated the submissions made in their respective writ affidavits.

3. Heard the Learned Government Pleader for Co-

operation as well as the learned standing counsel appearing for Karimnagar Cooperative Urban Bank Limited.

This Court finds that on an earlier occasion, a writ petition in W.P.No.21549 of 2025 was filed by one of the members of the Karimnagar Cooperative Urban Bank Limited, seeking a direction to the official respondents to take action on the letter addressed by the Joint Registrar of Co-operative Societies, Karimnagar District, on the irregularities committed by the Management Committee of the society in the maintenance of suspense and ledger accounts and this Court had directed the respondent No.3 therein i.e., PIC/Chairman, Karimnagar Cooperative Urban Bank Limited, to take action thereon in accordance with law within a period of four weeks from the date of receipt of a copy of the order and pursuant to the said order, the petitioner in W.P.No.25985 of 2025, in the capacity of the PIC/Chairman, has initiated action and has issued a show cause notice dated 09.07.2025, to which the petitioner and others have submitted their explanations on 22.07.2025, 30.07.2025 and some other dates. It is noticed that one of the petitioners had requested to furnish the copies of records vide letter dated 22.07.2025 to make his further submissions, while others submitted that they are not responsible for the alleged irregularities mentioned in the show cause notices. Thereafter, the respondents appears to have conducted a General Body Meeting on 03.08.2025 and passed a resolution on 04.08.2025 for cessation of the membership of the petitioners and the consequential proceedings dated 08.08.2025 have also been issued. In view thereof, the respondent No.5 has addressed a letter to the respondent No.2 to approve the cessation of memberships. However, the respondent No.2 has observed that the action for cessation of membership has not been taken in accordance with law and therefore, the said resolutions cannot be approved. Thereafter, the petitioner in W.P.No.25985 of 2025, addressed a letter dated 19.08.2025 to the Commissioner for Cooperation, to look into the matter and direct the District Co-operative Officer, Karimnagar, to approve the letters of the petitioner dated 04.08.2025 and others and cancel the memberships of the persons mentioned therein and in response thereto, the District Co-operative Officer, Karimnagar, vide proceedings dated 25.08.2025 has held that the action cannot be approved as proper procedure has not been followed. Challenging the same, the W.P.No.25985 of 2025 has been filed.
