HONOURABLE SRI JUSTICE B. VIJAYSEN REDDY WRIT PETITION No.14404 of 2025 ORDER : (ORAL)

This writ petition is filed by the petitioner seeking to direct the respondent authorities to take urgent and immediate steps to prevent illegal encroachment of the open land admeasuring 32,243.33 square yards in Survey Nos.113/1&2, situated at Gachibowli Village, gifted for the purpose of laying roads, public parks, utilities, open space etc.

2. Heard Mr. M.D.Mohapatra, learned counsel for the petitioner; Mr. G.Madhusudan Reddy, learned Standing Counsel for GHMC, appearing for respondents No.2 and 3; and perused the material on record.

It is stated that originally, the land admeasuring Acs.16.26 guntas in Survey Nos.113/1&2, situated at Gachibowli Village, belonged to one Ms. K.Jayalakshmi and Ms. G.Vasundhara Devi; they approached HUDA and obtained approved layout in respect of the subject property. The petitioner herein is an association formed by the purchasers of the plots forming part of the above said approved layout situated at Gachibowli, Hyderabad. That out of the subject property, an extent of 32,243.33 square yards was allotted for the purpose of laying roads, public parks, utilities, open space etc. Pursuant thereto, the owners of the land executed a registered gift deed in favour of Serilingampally Municipality vide document No.2651 of 1993 and handed over the possession of the subject property in favour of the Serilingampally Municipality. While so, it was noticed that some of the residents of the colony/third parties are trying to encroach upon the subject property which was already gifted by the owners to the Serilingampally Municipality. Aggrieved thereby, the petitioner submitted representation dated 20.02.2025 to the respondent authorities regarding the illegal encroachment upon the subject property, however, action has not been initiated so far. As such, the present writ petition was filed.

4. Learned Standing Counsel for GHMC submitted that appropriate action will be taken on the representation of the petitioner will be duly considered in accordance with law.

Recording the aforesaid submission, without entering into the merits of the case, this writ petition is disposed of directing respondents No.2 and 3, to consider the representation of the petitioner dated 20.02.2025 with regard to the illegal encroachment of the land admeasuring 32,243.33 square yards in Survey Nos.113/1&2, situated at Gachibowli Village, gifted for the purpose of laying roads, public parks, utilities, open space etc., by giving opportunity of hearing to the petitioner, and to the residents of the colony and to all other concerned/ interested persons, and pass appropriate orders in accordance with law, within a period of four (4) weeks from the date of receipt of a copy of this order. There shall be no order as to costs.

As a sequel thereto, miscellaneous applications, if any, pending in this writ petition shall stand closed.
