THE HON’BLE SRI JUSTICE LAXMI NARAYANA ALISHETTY WRIT PETITION No.29481 of 2015
ORDER:
This writ petition is filed aggrieved by the inaction of respondent No.1 in considering the representation submitted by the petitioner Association dated 27.04.2015 seeking permission to allow the members of the petitioner Association to park their vehicle in parking space near by the Begumbazar Fish Market, as illegal and arbitrary.
2. Sri M.D.Mohapatra, learned counsel for the petitioner and Sri M.Arun Kumar, learned counsel for respondent No.1 and learned Government Pleader for Municipal Administration are present.
3. Learned Counsel for the petitioner would submit that the petitioner is an Association registered under the Andhra Pradesh (Telangana Area) Public Societies Registration Act, 1350 Fasli; that the members of petitioner Association engaged in the business of transporting Kirana Goods from Begum Bazar to Twin Cities, and they have been parking their transport vehicles near Fish Market, Begum Bazar, Hyderabad (for short ‘subject land’), since two decades. While so, some local politicians started threatening the members of petitioner Association to remove transport vehicles from the subject land. The petitioner Association has submitted representation to the 1st respondent seeking permission for parking the vehicles in the subject land on lease basis. Learned Counsel would further submit that despite regular follow-up and repeated representations, the respondent authorities have not considered the petitioner’s request for allotment of parking space on the subject land. Aggrieved by the same, present writ petition is filed.

Learned Standing Counsel for respondent No.1 would submit that there is no space available for parking on the subject land; that, in fact, a new fish market has been constructed and thus, there is space constraint; and therefore, the representation submitted by the petitioner could not be considered.
5. Learned Counsel for the petitioner denied the submissions made by the learned Standing Counsel for 1st respondent and further submits that space is available for parking on the subject land. He also submits that the petitioner had submitted application seeking parking space on 27.04.2015, and since 10 years have elapsed, the petitioner will submit a fresh representation ventilating their grievance and the respondents may be directed to consider the said representation in accordance with law.

In view of the said circumstances, considering the submissions made by learned counsel for the petitioner and learned Standing Counsel for respondent No.1, liberty is granted to the petitioner to submit fresh representation ventilating their grievance and on such application being made by the petitioner, respondent No.1 shall consider the same and pass appropriate orders in accordance with law within a period of eight (08) weeks from the date of submission of application by the petitioner.
7. Accordingly, the writ petition is disposed of. No order as to costs.
Miscellaneous petitions pending, if any, shall stand closed.
