ORDER:

This Writ Petition is filed under Article 226 of Constitution of India seeking the following relief:

“…to issue an order, direction, particularly one in the nature of Writ of Mandamus, declaring the action of the 3rd Respondent in filling Final Report U/s.173 Cr.P.C. dated 11.10.2017 on 16.11.2017 on the file of the Honble XXV Meropolitan Magistrate, Kukatpally at Miyapur in FIR.No.177/ 2016 dated 20.05.2016, without complying the objections made on dated 13.10.2017 by the Honble XXV Meropolitan Magistrate, Kukatpally at Miyapur i.e., recording the statement of witness and complainant, or serving notice to petitioner or its withness for the same, as illegal, arbitrary, unjust, violative of principles of natural justice, violative of fundamental rights guaranteed under Constitution of India.….”

2. Heard Mr.B.V.V.S.Murthy, learned counsel for the petitioner and Mr.M.Srinivas, learned Assistant Government Pleader for Home appearing for respondents No.1 to 3.

3. Learned counsel for the petitioner submits that the cause of action in the present writ petition no longer survives for adjudication and, therefore, seeks dismissal of the writ petition as infructuous.

4. Learned Assistant Government Pleader raises no objection to the said submission.

5. Recording the submissions of both learned counsel, the writ petition is dismissed as infructuous. There shall be no order as to costs.

Miscellaneous Petitions, pending if any, shall stand closed.
